Visitor's Visa and an ongoing court trial

Hi, I am from Philippines, 26 years old and a rape victim, with the case still on trial. It happened back in 2014, but like many others have already said, it's gonna be a long process. The people responsible are already in jail, I have submitted all the evidences, including the medical records and just waiting for my subpoena. It has been a tough journey for me.

While waiting for my next hearing I want to come visit my boyfriend in Ontario and meet his family and friends. In all honesty, I would want to finally put this behind me and move on, but I couldn't just abandon the case because

1) My sister is also a rape victim, and she never had the justice because she was unconscious and never recognized who did it to her. So for me, to win this case is to also win it for my sister.

2) One can tell if a person has changed, but the people that did this to me would often smirk at me inside the courtroom which gives me the idea that letting them out would just endanger many other women, even my family.

This is our dilemma, me and my boyfriend somehow tries to live and focus on the good than this. He is a Canadian, has a stable job (runs a business with his Mom), 27 years old. He has already visited me once, last December 14th and stayed here in the Philippines for a month. I have been unemployed because of the nature of my experience, my fear is that I would only get denied if I applied for a Visitor's Visa.

If I would be completely honest about this case, is there any chance that they would approve my Visa because I have a valid reason to come back to my Country?

Thank you so much to anyone who would respond. God bless!

Job Offer........
Pre-Assessed..
Sorry to learned what happen to you.

What valid reason do you have to come back to your country? If I were you, I get a job or continue my education and take a vacation leave while employment/studies.

Hi! Thank you for your response! The only thing I have in mind right now is the subpoena from our Regional Trial Court. Do you think that would be accepted?
You could also include a letter from the court that they have granted you permission to let you leave and visit Canada but will return back for the next hearing.

But do keep the visit short like maybe 10 days because longer visits have shown to cause refusals in visitor visa applications.

Other than that, family ties is the next thing you can focus on. I'm assuming your boyfriend will be providing financial statements from his side to pay for the trip.

I think that this is really helpful, thank you! But if say the visit would be 2-3 weeks max, and is included in the letter from the court, is it still gonna be a problem? and Yes, I will be staying with my Boyfriend's parents and he will also be providing for the trip. How are family ties going to help? I'm sorry if I have lots of questions. Just really maximizing this opportunity!! Thank you so much!

Hi,

So sorry to hear about the trauma you and your sister have been through.

IMHO, I would recommend that you do not apply for a TRV. The harsh reality is your chances of a TRV approval are extremely low. You have already suffered unimaginable pain and stress because of the incident as well as reliving the trauma in the court.

Here's why I believe you should not apply for a TRV in the short future:
You are not employed + not studying + you don't have family members who are dependent on you for their well-being or their finances + your personal financial situation is probably not good (your boyfriend's financial support is secondary) + the visa officer could consider you as a potential over stayer because your ties to Canada would be stronger (boyfriend) + not sure if you have previous travel history (US, UK, Schengen, etc)

I hope everything works out well for you in every way
