My brother completed his Grade 10 from India and is in Canada with me since last 4 months. I asked the local high school and they are ready to issue him admission in Grade 11. I have questions:

- Whether visitor to student visa at high school level is possible?
- Whether my parents will need to give some king of guardianship for him to me in writing? If yes, I need the format.
- I am here on a work permit and someone told me that if I take custodianship of my brother that means my husband and I become second parents to him, his studies will become free and we will not even need to process the study permit for him. Can anybody let me know more details.

I will be so grateful. I really look forward for serious advise. Please do not reply if you do not have complete knowledge. I will appreciate it.

Firstly have you read this http://www.cic.gc.ca/english/study/study-minors.asp a good start for what is required for a minor to attend school just so forum posters are aware of your starting point.

I'll help with one question - no, his studies won't be free. Expect to pay around $14K per year for public high school (more for private).

Apologies if my answer was not of any use but the link has the information that you require for example a custodian form http://www.cic.gc.ca/english/pdf/pub/custodian-parent.pdf to be completed by the parents and the custodian in Canada.

Your brother for example is not your dependant but your parents dependant so not covered by your work permit conditions as a temporary resident so will need a study permit supported by the custodian document. Being a legal guardian with parental rights versus just a custodian are two different things as I am sure you are aware.

So apply for the study permit which will take time, complete the custodian form both parents and self plus any other documentation authorising your brother to be unaccompanied by parents or legal guardian in Canada

If you need advice other than a public forum not populated by experts but people trying to be helpful (mostly anyway) then maybe best consult a professional immigration lawyer given the remote chance anyone on this forum has experience of the same scenario. Plus if you get advice on a public forum that you believe is of no use in your mind just ignore do not respond as just tends to generate more advice you might not want, even ignore this post if you like.
