Hi Everyone,

I am in Canada on work permit since October 2021 and submitted visitor visa application for my spouse and kids and got refused with the reasons mentioned below. I am sharing the details of the application. Can someone who has gone through similar case of rejection and successfully got reapplied and got approved please help. Your advise would be much helpful and appreciated.

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and in your country of residence.”
  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your purpose of visit.”

My intention was that they would stay with me for the duration of my work permit and I mentioned the same in the sponsor letter. Some of my work colleagues who applied along with me providing the same reasons and duration of stay got approved. I am wondering why mine got rejected. In the family relationship document of my spouse , I have given her family members details and marked them all as "Not travelling to Canada".Does that not suffice to convince them we have family ties back in India?If not what additional documents do we need to show for family ties and purpose of visit.

Sorry I didn't understand.Did they apply for same visitor visa? For visitor visa, max length of stay allowed in a single entry is 6 months, they have to exit and come back

yes all my other colleagues applied for visitor visa for their dependents.

Are you on closed/open work permit? You should have applied for your spouse and kid along with your work permit as group application. And for spouse you should have tried SOWP and TRV for the kid. You can check with some consultants and take opinion..
 
Thanks for your reply. I am on closed Work permit. I had to apply separately due to circumstances at that time.

How old are your kids? You asked for a visit of 1.5 years which is not visiting. It is moving to Canada. Now, your wife should apply for a spousal work permit and depending on your kids ages, study permits. Assume you wanted your kids to go to school.

Six months are too long, man. That's a silly mistake in the application.

Visitor visa is max. 6 months stay only. You need to arrange a consult with a professional before trying a new application.
 
You applied for 1.5 years on a Visitors visa?

Try for 20 days and state family reunion. You might get approved. Better still to apply for SOWP and kids TRV.

Thry are not visiting you which is the main issue with your application. If your job is in NOV 0, A or B you need to apply for an OWP for your spouse and TRV for your children (many VOs prefer study permits for children 4-18). If you apply for TRVs for the children it can only be for up to 6 months.

While re-applying I am seeing the below questions. Can someone help with me with what would be a suitable reply for this.?

Have you ever been refused a visa or permit, denied entry to, or ordered to leave any country or territory?

You answer YES. On any visa or permit applications from now (for any any country) they must answer YES. As advised, your spouse should be applying for a SOWP and children for study permits if over age 5.
