Visitor Visa for Spouse

Hi. May I ask what's the best way to apply for my wife's visitor visa?
I'm an international student (student visa holder), Winter 2022 intake, and I've been here in Canada since March 2022. We also applied for a student visa (me) and OWP (my wife) last year 2021 and both of us got rejected. Any advice and recommendations?

Also, I have a few questions as well:
1. Is it true that we can invite a spouse to go to Canada? If Yes, will this be an advantage to have a higher chance of approval, and what are the requirements and processes?
2. If item #1 is not applicable, should I apply for my spouse's visitor visa using my own IRCC account or does she need to create one and apply on her own?
3. Do you recommend buying a plane ticket before applying for a visitor visa or should we wait first for the approval of the application?

Thank you

Hi
I would suggest you apply for a visitor visa for your wife as I recently did the same for my husband and it got approved. I am also an international student who came in January 2022 and applied for my husband and daughter after 2 months.

1. To answer your question about higher chances of approval, i think it is down to VO's discretion and how strong your application is. People do get approved when they apply together so the rejection you received could be based on your application and what exactly you provided.

2. I think since she is applying on her own she needs to open a new account and apply as an immediate family member. It would be different if you were making the application together as a family when you applied for your study permit. But now she would be coming to Canada on her own I assume so new account is preferred.

3. No ticket please lol. I am not sure why people do this. Its risky. Although there are sites that you can go on where you pay a little for them to generate a flight itinerary for you without paying the full ticket price. However I would suggest you dont book any flights till you are approved. Even the visa officers dont recommend this. I certainly didnt do this in my case.

So I think a visitor visa would be the best option for now. If you need any help please DM me and I can help you as much as I can. All the best x

A visitor's visa will only grant your spouse a 6 months stay in Canada. To stay longer, a visitor's record is needed.
Any idea how long more can you stay with this visitor's record?

How does applying for a visitor record affect your chances of coming to Canada again, or applying for a spousal visa?

Yes A visitor visa can be valid up to the expiry date on your passport but you would be granted a stay of 6 months on entry to Canada.

While a visitor record is needed to extend your stay , in this case I don't believe you need it because your spouse will apply for a work permit once he lands in Canada which will provide him with a valid status to remain in the country. If he also applied for the work permit before the expiry of his stay, I think he would have what is called "implied status" which allows him to stay in Canada till he gets a decision on his work permit application

I am not sure how often you can apply to stay on a visitor's record.

This information is based on my own research and I may not be providing accurate details. I would suggest you go on the IRCC website to get more information concerning this.

But is the work permit granted to all spouses of student visa holders? What does IRCC look at to determine whether to grant the OWP to the spouse?

What difference is there if you apply for the spouse's OWP when you are making your initial study permit application, versus applying when they come on a visitor's visa, and you are still on a student's visa?

Does your husband hold an OWP now?
