Hey guys!

I am coming from the US and got here on December 28, 2018 which means I have valid visitor status until June 28, 2019. We sent in our Inland Spousal-Sponsorship PR application with OWP hoping to get an answer on the open work permit before then, but recently had it returned due to a missing document. Now that it's less than 2 months away, I had some questions about keeping legal status.

1. Does having the OWP give me legal status in Canada while waiting for my Permanent Residency Application to reach a decision? Or do I also need to keep my visitor visa valid?

2. Would submitting my application for an OWP with Spousal-Sponsorship PR Application give me implied visitor status if my original visitor visa status expires before I hear back from the OWP? Or should I also apply to extend my visitor's visa while waiting for a response?

3. If the OWP gives me legal status in Canada AND gives me implied status, is that enough to travel to the US and come back without any hiccups at the border or being denied entry?

Thanks for any help you can provide.

1. OWP is enough.
2. You should apply to extend your visitor status just in case your sponsorship + OWP application is returned again.
3. Re-entry is never guaranteed. But chances are very high.

1. Yes, the OWP gives one status.

2. If visitor status expiration date comes and goes while an OWP application is processed (meaning it hasn't been returned, awaiting decision), the applicant will go on implied status. If the OWP is approved, no worries. If the OWP is not approved (rare) and the applicant has not received a visitor extension, then the person is no longer in status. This, however, would not impact the PR application. So... what some people do in cases such as yours is apply for a visitor extension for a bit of a safety net. You can do this until right before your original visitor expires.

3. Re-entry is highly likely. Make sure to bring the OWP for an easier experience.

Hi i mailed my extension of stay for my visitor visa this week because it was going to expire on the 8th of may while waiting for OWP and PR application response from CIC.
However today we just received approval of OWP - do i need to with draw/cancel the extension of visa application and request refund immediately? or should i wait for response from CIC on what to do?

If the OWP is approved, withdraw and get your money back.
