Visitor visa exepmt - NEED HELP

Hi,

I have italian passport I came to Canada on October 2011 as a VISITOR for 6 months. The agent asked many questions , and finally he asked me if I want to work in Canada ! I thought it's a trap because I heard I'm not allowed to work so I said no I want only to visit , then stamped my passport (accepted) at the airport entry.

Now I heard that I could have obtained a work permit if I said yes !! because it seems that if someone is from country (like Italy) and who intend to stay in Canada for longer than 6 months can get a work permit ( *** BUT I don't know if that work permit needs work contract or not *** ).

Now it's August 2013 and I'm still a student since January 2012, I will fail this year and I'm so deseperate , please tell me if I can get a work permit because I'm visitor visa exempt... I can't apply for off campus work permit because my grades are poor and I stoped going to school. My study permit is open until october 2014.

This is not correct. An Italian would need to apply for a work permit before coming to Canada with the intention to work.

There is also the IEC program for a working holiday for Italians between 18 and 35, but there is a chance you'd be turned down if you looked desperate to stay in Canada.

@frege : I'm in Ontario (ottawa) , I'm willing to move anywhere and get a job offer and LMO, please suggest me what to do , I don't have experience in those things. I need to get a job by November/December 2013 !

I think you should look into federal and Quebec temporary worker programs.

I don't have any experience with that kind of application. So you should ask questions in the "Foreign workers" section of the forum.

Generally, you need to find an employer who wants to hire you.

If you already speak French or think you can learn it easily, then permanent immigration will probably be easier in Quebec than it is outside Quebec. The "Programme de l'expérience québécoise" is a relatively liberal program for foreigners who have been working in Quebec in a skilled profession (skill level "C" or higher in the NOC), and it is not subject to quotas.

I don't know much more about these things, so please ask in that part of the forum. Good luck!

Edit: Here is the NOC skill classification. If you can find a job in Quebec at skill level C or higher, work there legally for 12 months or more, and learn French to advanced-intermediate level, then you will probably be able to stay in Canada permanently via the PEQ.

A visa exempt person can apply for a work permit upon entry to Canada, however, only if they have a work contract and an LMO or they are LMO exempt, for example a spouse of a student or skilled TFW and can prove it so it does not apply to your case.

If you had said you wanted to work as you entered Canada, they could have refused you entry and sent you back home.

The way to get a work permit is to find an employer who will apply for an LMO (labour market opinion) for you so that you can get a work permit. The only way to find that employer is to apply for jobs until you find one. You will get many employers who are not interested in wasting their time with an LMO, especially because they will only get one if they can show that they could find no Canadians for the job but if you give up, you will not find a job and get a work permit while if you keep at it, you have a chance.

You are not allowed to work until you have a work permit. If you work illegally, you risk being deported.

Finding the employer will take time and getting the LMO will take time so you may not be working by Nov/Dec. even if you find a job now.
