Hello

My wife relocated to Calgary in Jun 1, 2016

Myself and my wife got married in Calgary in Jun 19, 2016. We are expecting a baby next feb. She is currently live with me. I just send out the family class sponsorship (in Canada) package yesterday. So in the meantime of the process. Does she requires to extend her visitor status?

Because the stamp on her passport is jun 1, 2016 which as visitor it expire in November 29, 2016.

I already submitted the temporary residency form for her in Jun 30, 2016 as back up plan. So not sure if it is necessary.

Since you submitted an Inland application, you should have included the OWP application as well. This would have given her Implied Status and would not have required a visitor extension.

Can't they file the OWP still? That would give her implied status. and she could work too...

In theory, but...if CIC doesn't `connect the dots', the person could eventually lose status.

Most Inland applicants include the OWP with the application (in the same package that is mailed to Mississauga). CIC eventually routes the OWP (internally) to the OWP department in Vegreville.

For those that send the OWP separately, to Vegreville, they're at the mercy of CIC matching it with the Inland application, since it is the Inland application (and the legal status of the applicant) that qualifies them for the Pilot Program OWP.

Plus she is 18 weeks pregnant. So she can't work either.

So here another question. If I did not apply OWP or TRP for her. Doesn't that mean after the expiry date she is "out of status"

Because we apply for inland application and we have doctor's letter indicated that she is pregnant. So wonder if she need to do any extension. Plus we are not planning to go anywhere for vacation / honeymoon yet because we are worry about her status.

What is her status? visitor? I would assume it is...

Depends. If he is a PR then she is not eligible, so the ship has sailed. If not then he can still send it.

She cannot work unless her status is worker.

No, it won't.

But is she even eligible? If you did not send the WP application with the Spousal PR application then she will have to wait.

Yes, she would be out of status.

You need to apply for any temporary status.

No I didn't include the OWP for in the application.

So I will have to send it next week.

Not true. She IS eligible because of the submitted Inland application, since she still has legal status. It doesn't matter if the sponsor is PR or a Canadian citizen.

The OWP is generally issued for 2 years. That means she can remain for 2 years.

When you submit an application for any TRV the applicant is under implied status until they decide.

At least is under implied status now.

Do you guys think submitting the OWP is good for her too?

So once the inland application received by CIC and in progress of reviewing. Does she still under the implied status or she require to extend her visa ?
