A friend came to Canada from Mexico on a 6 month Visitor Visa. She got married here. Later she got a 12 month extension while Spousal Sponsorship Application was being processed.

After several months the Sponsor withdrew the Sponsorship application due to domestic issues. They are separated.

My friend’s visa expires next week. Can she apply for a Visitor record to legally, temporarily stay in Canada while the Visitor Record application is being processed?

Thanks.

She can apply for a visitor record and maintain status.

She should be expecting that she will have to return to Mexico relatively soon. She was only granted such a long stay because she was waiting for sponsorship to be processed. It would be highly unusual for a young person to be able to remain in Canada without working for over a year so unless she is independently wealthy and can live without working she should expect that future extensions are unlikely.
