Visitor record for future PR/5 year ban

Hi all,

I was wondering if someone could help provide any insight on the following. Apologies if this has been asked before, I did a search and couldn't seem to find anything similar of recent times.

I am a PR previously sponsored by my ex common-law partner, PR granted in September 2016. We separated in June 2017 and I have been single up until meeting my current common-law partner. I would like to sponsor my common-law partner but I am currently under the 5 year ban until September 2021.

Unfortunately, I had to leave Canada temporarily (to the UK, birth country) at the end of August 2019 but am now planning my return to Canada around December 2020. Our plan is to go to Canada together and he would enter as a visitor which would last 6 months (June 2021). We would then apply for a visitor record before the expiration of his visitor status with reasoning being that I will be sponsoring him in September 2021.

What do you guys think of this? My concern is that a visitor record with the reasoning that we're waiting until my 5 year ban is up is not valid and then he'd have to leave. We're happy to apply for the OWP when we do the application to maintain status that way but it's just getting up to that point I'm worried about.

He can apply for a visitor record with a clear intent to later apply for PR, as long as the visa officer is satisfied he will leave Canada when he needs to if the PR application is refused. This is called dual intent and is perfectly legal if he can show ongoing family/employment/property ties to the UK.
