Visitor Extension rejected while waiting for sponsorship

Hey all,

I was hoping for some advice. Here's our current situation.

My wife (I am a Canadian citizen) came to Canada about a year ago from the US. We were able to extend the visa towards the end of her 6 month visit for a year, as a tourist visa.

During that time, we organised and got married in Canada.

Once married, we filed a sponsorship application with an open work permit, but concerning the time it took to process inland, we decided to re-extend the visa while the sponsorship application was going to be processed so we could stay together.

We provided the best information we had, and hope we could stay together during the process.

We got a rejection today.

The reasons we got seem a little boilerplate, but I guess I could elaborate if it would help.

We applied for the extension well in advance (more than a month), and just got the rejection today, where the visa has expired since January 25th or so.

Considering the above information, does the application for OWP allow her for legal status? We still haven't received a confirmation that the spousal sponsorship has been received.

If not, does this mean that we have to find a means for her to leave Canada immediately?

Also considering that we applied for sponsorship inland, does this mean that in the case my wife has to leave Canada, do we have to update or redo the application?

Thanks, and sorry if some things seem disjoint above. I am quite shaken up.

Hello scylla! I've seen numerous of your posts and they've been very helpful, and wanted to thank you!

We submitted the inland application around January 15th.

As long as the PR/OWP application is accepted as complete, she can remain in Canada under implied status.

I would apply right now to restore her status back to visitor providing evidence the sponsorship application has been submitted. This is insurance in case the sponsorship application is for any reason returned as incomplete.

I can't comment on why the extension was refused. It may have been what was included in the application. Sometimes applying too far in advance can result in refusal too.

I don't see any point in applying for Restoration. OP's spouse has valid Implied Status right now and therefore doesn't qualify for Restoration.

When did you applied the re-extend record?
Did you submit by paper based or online?
I submited paper based on Oct 25 in Edmoton. But not yet approved. :(

Hi, I am in a similar situation, but I have not received a decision for the visitor extension, yet. I am very worried that I would be refused. I submitted my sponsorship application more than a week ago, but I think the result for the visitor extension will be given much earlier than the time receiving AoR.
Can you please share with me how it went with your situation?
Please help.
It will be very hard for me if I have to leave because I applied for inland common-law sponsorship, which requires me to stay with my partner together.
