Hi!
I'm about to make a visitor extension but I have a couple of doubts, a bit of context before getting to them:

- This past week my fiancé and I reached the year living together which technically makes us common law and we're getting married in July 31st
Should I put him as my common law in the "Family information" document? Someone told me we should fill the form IMM 5409 (Statutory declaration of common law) take it to a police station and ask a commandant to sign it and then send that with the rest of the extension documents

· Is that true? Or it's enough with writing there that he's my common law and then as soon as I have the marriage certificate add it to my application for the extension?

My fiancé is a French citizen that's here on a working holiday visa. The company he works for, asked for a 2 years closed work permit so he can have time to wait for the permanent residence answer (he's gonna send the papers after we get married).
We plan to apply for an open work permit for me through his closed one, so that's why I want to be sure I do the right stuff with the extension information

1, You are now common-law. Your application needs to reflect that.

2. The statutory declaration is not mandatory, and I doubt a police station "commandant" would sign it since you need a lawyer or a notary to notarize documents in Canada. The declaration may be helpful in your case though.

So, considering we’re getting married in less than a month and I’m adding a photo of the invitation to the extension file, it should be ok if we don’t ask for the statutory declaration of common law, right? I’m also planning to send the marriage certificate as soon as I have it :)

If it isn't mandatory, you can try without it.
