Visit or Tourist Visa for Wife

Hi All,

I have a Challenging situation here :( and was hoping your inputs to make a decision.

Currently I am a Permanent Residence in Canada, Immigrated in Nov 2011 and staying in Toronto, I recently got married in the month of March and was preparing to File Sponsorship Visa for my Wife however understood that the whole process takes approx 8 to 10 months. I wish my family could be here asap and we dont have to wait for approx a year to get them in Canada.

Hence I was thinking to apply for a Visit or Tourist Visa for my family (Wife and Parents) and get them here and do the sponsorship paperwork simaltaneously as by the time the process takes place they stay with me for that period.

In order to do so I have 2 options to get my Wife on a Visit Visa

a) Send them sponsorship letter and other details and intimate visa officials that she is coming to stay with me for some time

or

b) Book a Tour Package for her, come on a tour package and get a Visit Visa.

Kindly advise as to which is the best way to apply for visa with rare chances of denial, My parents and Wife are not working back home town and my wife does not have any past work history.

thanks all for your revert, As far as i know for one visit a visitor can stay upto 6 months and hence if I look at a year to get the sponsorship in the family class for my spouse in worst case I will have to go to US or Back home town and come back for extension for more 6 Months, Within this Year I think the Sponsorship decision would have been taken, Secondly I dont want my wife to work so thats not an Issue.

I would want my wife to stay with me as long as they can and at the earliest, If this involves renewing the visitor visa no issues, rest family sponsorship for wife and supervisa for parents will be a simaltaneous process initiated by me which will happen eventually based on the processing time

pls guide, should we get the Visa through a Tour package or through an Invitation letter in order to get her here asap.

If you wish to bring her here on tourist visa and then file sponsorship you'll have to fill inland application for sponsorship. If you wish to sponsor her while she is in her home country then it would be outland sponsorship. Inland application takes longer time to process, reason being she is physically with you so there is no urgency to process her file.

You also have to keep in mind if she is coming here as a visitor, she will have to leave once the visa expires, she is also not entitled to healthcare nor studying or taking up employment of any kind

How does it work when you apply inland in terms of maintaining a legal status there? Do you have to keep renewing VR/Visas or are you granted a legal status until you hear back a yes or no from immigration? Which can take up to 18 months or so.

Once I marry my Canadian girlfriend I intend to apply for PR from the UK because I know it's quicker and I know I can still visit whilst waiting for a decision, I don't really want to spend up to 18 months in Canada not being able to work as savings will take quite a hit, though it does give me food for thought if it makes it easier to stay there for a long period though I think I would rather get a quicker decision.

Yes, and its your responsibility to manage that, i.e, if a PR inland app s running doesn't automatically stand ground for extension. Now, if she was here as a student visa then the visa period is longer

You are right they will have to continue renewing their visitor visa, with no guarantee should they refuse to renew at any point

I see. I'm sort of in the position of the OP's wife (though being from the UK maybe a little simpler) though I think the shorter term pain of applying from outside may be better for the quicker decision you get. It also depends on finances, and if you can afford to keep flying them back and forth OP which may happen?. If you could gaurantee you just fly them over the once, apply for the PR, they keep extending the paperworks and let them stay the entire time and then say yes you've got the PR it then it would be a no brainer but who knows.

Well, six months is allotted time and one can visit US and back to Canada for another six months ( subjective )

I knew 2 situations

Family migrated to Canada on business visa..the young son as married but the wife entered Canada on visitor visa ( same day but separately ), the remarried inside Canada and applied for Inland. Immigration denied it and they appealed and won

Another case was where fiancee wanted to visit, applied visa and got refused and waited for her PR app to get over

IMO, better to wait outside till the whole thing is done

PS: Tour package is a good idea with other members

I was thinking to consider the option for tour package as its the quickest way to get my family here, do i give my details (like invitation letter, PR Copy, Salary Slip etc) as they are coming to meet me or just simply don't show any traces of mine and come on a tour package and get the visa. Pls advise.

Double-Edged sword. Tour is safer
