Maybe i could get some help here,i am married to a cuba resident.Would applying for my wife to visit canada be better than going through the sponsership process.Mainly to be sure she likes it here.Also is a visa required to visit when you are married?

A visa is required regardless of martial status to a Canadian. The only exempt is for a citizen from a visa exempt country such as the USA, UK, etc.

A visitor's visa won't allow her to reside in Canada permanently, whereas permanent resident application would. If you want her to live in Canada permanently and be allowed work and have healthcare (in most provinces) she must be a PR.

I would recommend trying for a visitor's visa before applying for her PR however. It's good to show she tried to visit you. Even if is denied, it shows she tried to visit you and spend time with you. Since her husband is in Canada, the chances are her visitor visa will be rejected. It's rather common, nothing to take personal. A lot of people have overstayed their visits in the past (who would want to leave their spouse?) so the VO is very stingy with the visitor's visas. If she does get the visa, then great! If not, you can decide about PR application next.

I'm not sure I agree with a spouse's rejection of a visitor visa as being a good thing, because if you look at the sponsorship forms, on one page, it asks if the person ever had a criminal record, applied for refugee, been in jail, etc, and one of those questions was, have you ever been rejected for a visitor visa. It seems that if one were to answer YES, to any of those questions, would be a red flag.

This is why my fiance and I decided not to apply for a visa to come here, because in the event she gets rejected, we don't want ANY blemishes on our application, no matter how small, so that we can maximize our chances of success.

If you're married, just apply for sponsorship, she will be able to live with you.

I tend to agree that trying for a TRV would be a positive note.

It shows intent to be together, which is a good proof as far as the relationship being genuine. I can understand it being negative towards the application if the person sponsored made multiple attempt's before the current relationship. That would only show them trying anyway possible to get out of their country and into Canada.

I have read some of the appeal cases (found a link here on another thread, and not sure the url, or I would post it), several of the cases the applicants were actually questioned as to why never tried to re-unite prior to applying for PR.

Just my 2 cents though! ;D

The general advice given by the seniors here is to try for a TRV. It's completely up to you whether you do it or not. If you have an extensive visiting history in the applicant's home country or a third country, it would probably work as well. I will admit (and I've read dozens of CanLii cases) the VOs seem to prefer a TRV attempt.

Visiting is one area where quantity and quality are on equal footing it seems.

Just my observations. I've kept no notes or done official research here.

Hi...I was denied of a visitor visa last August 2012, so my husband who was my fiance came here Sept 2012, we went to Thailand, went back to Canada October then November he came back to the Philippines & we're married December 2012. Hopefully we will submit our application this April or May 2013. Will it (denial of a visitor visa) affect our application for Family Class Sponsorship? Would it be a red flag because I answered YES in one of those questions "have you ever been rejected for a visitor visa?"

Please help...Thanks...
