Visit Canada after outland spousal sponsorship application submission?

He can apply for a TRV, though it has a slim chance of being approved. If it's approved, he will need to request his passport in order to submit it to receive the TRV. This could mean delays in his PR app. You will also need to consider that he will have to return his passport to NDVO to complete the PR process.

you mentioned that his passport is with Canadian Embassy in India.... Does that mean he submitted his passport for Immigrant visa stamping ? If yes, then he should get back his passport in few days with Visa and he can land as PR in Canada immediately after that so better wait for few days before applying for TRV.

Your reason for TRV can go in your favor and can totally go against you as well. It depends on the visa officer who is issuing the TRV. I would say dont take that risk because if you are pregnant and your husband is visiting you then there are high chances that your husband will not go back to India...think like a visa officer....this reason will be alarming for him ........ you can attach a letter with the TRV application mentioning the spousal application file number and your husband's job letter, bank statement, property paper in India etc. showing his strong ties with India. Be honest and write that there is no way your husband will stay in Canada more that the authorized period because his PR application is in process ...he has to go back to resume his job ..... he just wants to visit you during his vacation ...... It is all about convincing the visa officer that your husband has strong ties with India and he will definitely go back and will not overstay in Canada as a visitor.

There is no harm in trying ..... whatever will be the verdict ....it will have no effect on your spousal application.

Thank u so much for the reply . It definitely does help. When we applied in late 2013 they were asking all applicants for their passports at that time and it has been with them ever since. ( which is completely unfair considering that it is a legal document ) . Its not like it is right now where they ask for PPR only when they are ready to submit the visa

I agree with your statements re: the visa officer . This could work as a pro as well as a con. However I plan to write an extremely genuine letter explaining or situation and guaranteeing that he will not stay over the stipulated time period. I also plan to send them proof of the pregnancy.
The only q is should we get his passport back or just apply the TRV stating that the passport is with them already?

Late October and his parents will provide letter invitation

Hi Shahmad and everyone,

I am glad to see this post. Thanks to everybody for sharing their experiences!

I have some questions related to Shahmad's reply to spouse visitor visa.

Spousal application applied for my wife in Abu Dhabi: March 2014

Received email from Canadian Embassy Abu Dhabi to submit the passport: Oct 2014

Passport Submitted: Oct 2014

Visa stamped: Oct 2014

Wife landed as PR: Nov 2014


My two cents ....... It is a common understanding that once you have applied for spousal sponsorship, you cannot apply for the visit visa for your spouse and she/he can not visit Canada and live with you while your application is in process ...... this is absolutely wrong ..... After applying for spousal sponsorship for my wife ...I immediately applied for her visit visa and I attached a letter with the visit visa application mentioning honestly that my wife's immigration application is under process and since the process takes time my wife would like to visit Canada and see me and there is no reason why she will stay in Canada more than the authorized days because her immigration application is already underway. ------------------------ I have applied for my Wife's PR on July 15, 2015. Is it necessary to wait till I get my Sponsorship Approval and only apply for visitor visa after that or I can still mention my UCI/client ID in my letter of invitation saying that I already applied for PR and it is in sponsorship approval process and go ahead with the visitor visa application? This is important for me to understand because I don't want to lower the chances of my wife's visitor visa because of this reason. Please confirm. I was thinking that it does not matter as visitor visa process is independent of the PR process and canada does recognize "dual intent" immigration which means a person can always try for visitor visa while his/her PR is in process irrespective of where it is in approval process and that I can apply immediately for visitor visa after applying for PR because of this supposed reason. Can you please confirm Shahmad?

Applied for visit visa: April 2004 ... Got 2 years multiple visit visa in 3 weeks ...... she came to Canada in May 2014 and only went back to UAE in Oct 2014 to get her Immigration Visa stamped and came back to Canada as PR in couple of weeks. -------------------- Let us say that my wife gets visitor visa to Canada and she comes around Sep 20, 2015. I applied for her PR on July 15, 2015. Now, let us say that she gets her Passport request around Feb 2016 and at that time she is over here. In this case, is it possible to tell CIC that my wife is here and she wants to get her stamping done through Ottawa office instead of going to India and coming back as PR? Now, during the course of granting PR lets say over here if the CIC officer finds out that she has overstayed in Canada compared to what was written on visitor visa application won't that create a "problem". I know I may be thinking too much or it may be difficult to answer this particular question but again Shahmad as you have done this or have experience related to this, can you please clarify?. Thank you very much in advance.

So, I will say don't wait and give it a try ....... it has no effect on your spousal application and you can live together while your application is in process.
