Visa Rejected- need help

got my visa rejected today. The Reason was Given your long-term temporary residence in United Kingdom and lack of logical preogression in studies to compel you to take this program, I am not satisfied that you would be a genuine temporary resident in canada .

For F**k sake , i am a genuine person.

Well the story is I did my graduation in 2008 in Comp. Systems Eng. Snce than i was on my PSW visa.AS my visa was nearing expiry date I applied for the 1 year Computer network admin course in NAIT in alberta in sep 2010 but was rejected visa on the financial grounds. My UK psw visa was running out so i didnt had the time to re-apply that time therefore i decided to take a PGD course in Management which i will complete by the end of this month. I applied again this time with stronger financial proof but is rejected again with above reasons.

The only reason i took pgd in management was to extend my visa status (as most of the people i consulted said its better to apply from uk) so that i could re-apply for the same course this time.

Where did i went wrong? What else i could do if i have to apply again as i am not gonna give up easily?

I need some urgent help guys.

Really sorry to hear about your rejection. The reason is very complex :|

Now, every applicant is genuine. Its like facing an interview for a job position. Everyone who is called for the interview got what it takes to do the job but only the selected ones are the people who "CONVINCED" that they are capable. The problem is your application is at the "convincing" part.

It is very normal for the VO to be consider you as a poor applicant (not the literal meaning obviously; i meant weak) because of your previous records. You yourself said that " The only reason i took pgd in management was to extend my visa status" and VO will never like that. They only give permit to those applicants who got a solid aim to pursue and complete the course for which he/she is give the visa and nothing else. You did your grad in CSE and then you took a PGD in management (proves that you were desperate to stay in UK) and the VO feared that you will do the same till you get what you "actually" want to accomplish and VO only want the applicants to accomplish what they are give the visa for.

Well you should reapply with a stronger reason to overcome the mixing that you did in your case. Remember, there are always ways to convince oneself out of any situation in this world; even from a murder! It may not be easy but it not impossible also.

All you can do is make your case stronger. Consult with an immigration lawyer over there (I am sure there are lots of them in UK).

One of the main things that helps is showing that your employment prospects in your home country or some country other than Canada will improve because of whatever course you want to study.

For instance, if your employer in the UK could give you a letter saying that you would be re-employed in the UK on Tier 2 or whatever after completing your program in Canada, that really strengthens the application. Or show that you have employment prospects in your home country -- letters from prospective employers or referees would really help.

I did mention in my SOP that since i could not get my visa last year i applied for the pgd Management course to gain the skills required to manage my skills in the real time situations like setting up my own business. But they didn't looked satisfied.

I don't know what to do? ...i haven't done myself any favours by taking this course while waiting to apply again for canada.

I might have to consult a lawyer a i cant figure out what exactly would sought me out.

You may, in the worst case scenario, have to go back to your home country and work there for a year before applying again.

Two things will always make your case much stronger:

1) Get into a serious, academically demanding, and preferably partially/fully funded program. It's easy for the VO to refuse applicants for lower-tier programs or nondegree diploma courses -- much harder to refuse applicants for serious Master's or PhD programs. (Good programs are almost always funded ... the main thing is to get into them.)

2) Show that the program increases your employment opportunities in your home country or in another country in which you have residency or where the employer will sponsor your residency. A letter from a prospective employer can do wonders.

All this suggests that their is no quick fix to the problem n i am into deep shit. i dont like uk to be honest for various reasons and had few hopes with canada. Its not as easy at it may sound. ( Waheguru ji need help!!)

Yes your situation is quite complicated but maybe it is not the time to give up hope. Talk to an immigration lawyer, get a good sponsor, get a confirmed work order, show proper docs and if required, hide some of the things (not suggested) and re-apply. Sometimes, complicated situations may need 2 or 3 applications before getting the permit. So no need to lose hope.
