Visa Rejected due to LMO

Hi All,

Recently my Visa got rejected due to the lack of LMO document. I work at TCS-India and till now they did not ask for any LMO.

Starting frm this year many Visas got rejected due to the lack of LMO. Is the LMO mandatory to work at canada?

What is the time line to re-apply once we get the visa rejection.

Up until 30/09/10 No LMO was required for 7 software jobs in Canada, Now those 7 software jobs require approved LMOs (except BC/Quebec ends 31/03/11). So until your employer in Canada obtains an LMO you can re-apply.

Hi my work permit visa is refused and reason given was unbelievable it is stated that my LMO is expired. Fact is I applied 21 days before LMO expiry and visa officer made decision two months later. but it is clearly written on LMO to apply before expiry. I contacted a lawyer in Canada, He said you are right and you can appeal in Federal court but he asking to much fee and time period is 6-12 months which is to much. Any body have good suggestion?

Below are the points for rejection...

> You have not demonstrated that you come within the exceptions under section 186 of the
Regulations exempting you from the requirement to obtain a work permit or that your
employment in Canada comes within the exceptions to section 203 of the Regulations. As a
result, your offer of employment must be the subject of an economic effect determination before
a work permit can be issued to you. Your employer in Canada should contact the local office of
Service Canada to begin this process.

>You are not in possession of a valid Labour Market Opinion (LMO) from Service Canada.

>For an intra-company transferee application claiming specialized knowledge, officers consider a number
of factors including the applicant's experience, the description of his or her specialized knowledge, and
the proposed occupation and salary to determine if the claim is fully supported. You have not
demonstrated that you have the specialized knowledge required to meet the requirements of the LMO
exemption for intra-company transferees.

Can any one please explain the above points??

As you were told before, your Canadian employer requires an LMO before you can apply for a work permit. Your skills are not specialized enough to apply as an Intra company transfer.
