Hi all,

maybe someone that knows better than me the immigration laws can help me.
When the visa will be ready (I hope soon :-X), I have planned to go in Canada to validate and activate the PR, but there is a big problem. I can't remain in Canada for more than one week because I will have to come back in my country to manage some latest affairs (sell the car, the apartment, resign from my actual job etc.) and I think that I will not come back in Canada not before than 3-4 months :-( (the ticket plane is very expensive too).
Will be a problem?
There are a sort of rules that a person must follow to avoid to see his PR expired?

Another question (health card)
In Ontario site I read that:

Eligibility:
Ontario residents are eligible for provincially funded health coverage (OHIP). Generally, to be eligible for Ontario health coverage you must :
be a Canadian citizen, permanent resident or among one of the newcomer to Canada groups who are eligible for OHIP as set out in Ontario’s Health Insurance Act ; and
be physically present in Ontario for 153 days in any 12-month period; and
be physically present in Ontario for at least 153 days of the first 183 days immediately after establishing residency in the province; and
make your primary place of residence in Ontario.

What does it mean, in particular the last point (153 days of the first 183 days)?

No it will not be a problem. Rules only state you need to be in Canada 2 out of every 5 years.
What country are you returning to? If it's visa-exempt to Canada you won't have a problem, but if it's not visa-exempt then you need a special travel document to get back to Canada, or find a way to get your physical PR card (it's usually received at a Canadian address around 2 months after landing).


What does it mean, in particular the last point (153 days of the first 183 days)?
It means if you leave for 30 days or more, your 3-month wait for health care will reset at zero, and start again once you physically return to Canada again. So when you eventually come back to Canada permanently, that is the date you will need to start waiting 3 months from, NOT your landing date.

Dear All,

Can someone help me ?

I got my PR card on 25 Oct 2008 and it will be expired by 25 Oct 2013 this year. In terms of residency obligation, So far I only have less than 730 days:
- Only 2 months in yr2008 (5 Oct 2008 until 5 Dec 2008)
- Only about 2.5 months in yr2009 (15 March 2009 until 3 June 2009)
- Then I continously lived in Canada since 1 Sep 2012 until today and I would like to continue on until 25 Oct 2013 (the date when my PR card is expired).

My questions are:
1) If I go outside Canada after Oct 2013, can my wife sponsor me back to Canada ? if yes, how long does it take for her to sponsor me back to Canada ? For your info, my wife has met the residency obligation for her PR status.

2) If I stay and continously live in Canada even after my PR card expiration date, what is my status in Canada ? Can I be considered legally as an illegal person or is it 100% legal (correct me if I'm wrong that PR card doesn't determine my permanent resident status in Canada although my PR card is expired) ? Can I still work or apply for a job after my PR card expired ?

3) Related to question no 2 above, if I stay and continously live in Canada after my PR card expiration date, Can I apply to renew my PR card ? if yes, when the precise date should I go to renew my PR card in order for me to be approved (taking into account all those days I have spent in Canada previously) ?

I really need to get your valuable inputs for my case.

I'm replying again at my thread because my PR has arriving :), but I'm little bit worried :S
Let's explain :D.

How I have wrote in my first post I planned to go in Canada for just one week to visit my wife and for that date I'm pretty sure that the Visa will be already issued (now I'm in the passport request step).

At the border you recommend to declare that I want to entry in Canada as tourist or that I'm there to activate the Visa?
I'm asking you this because I don't know if it is better to activate now the Visa (it will expire in Jan 2014) or wait.

and at the boarder I have to fill many documents in particular the List of Goods to Follow etc...
But I will have with me only one bag (my personal tourist stuff), the complete relocation (with all my stuff) will be in a second time. So it means that the second time that I will entry in Canada I will not able to bring my stuff (laptop, guitar, computer devices, etc etc..)?

Just for information, but at the border they will open the baggage?

What would you do if you were in my shoes?‎ :)

Alberto70 - you certainly can bring your stuff the 2nd time you come to Canada, forum member Fencesitter is doing exactly that. Is that your only concern? If none other, I would declare that I'm "landing" first time in . . . Why wait?

I believe she can but I prefer where you are going with your option #2. As has been suggested to similar forum member situations' here, you remain in Canada until you can "successfully" renew your PR card, and do so then. It is not illegal to do this.

Thank you truesmile for the response, I totally agree with you...why wait :)?, my worry was the fact that the 2nd I can't bring my stuff :)
