Visa Extension Questions

Hello,

I have a few questions. Wife is from Europe, she has 1.5 months left before she has to go back home. We will be applying for permanent residence and a visa extension next week.

I looked at how long it takes to process the visa extension and it would be well over the 1.5 months she has left. It is my understanding she will have "implied status" after her current visa expires until we receive a decision.

1st question: If the extension gets rejected, how soon does she have to leave?

2nd question: If she wants to go home to Europe during the waiting time of the visa extension, can she? If not, is there a workaround or alternative option?

She would have implied status until the decision is made as long as you are in Canada. Though she can leave canada but will have to wait till she gets her visitors visa before she can come back. renew the visa before the expiry

1) if she applies for an extension, she would have an implied status until the decision is made. If she gets denied, then she has to leave asap to maintain a good record if she is planning of coming back in the future.

2) it will be her choice if she decides to wait for her extension back home but it will be up to the border officer to let he back in. http://www.cic.gc.ca/english/resources/tools/temp/visa/validity/implied.asp

When you say leave "asap" what do you mean? Do they not give you a date to leave by? The only reason I'm worried is the cost of airfare to fly last-minute can be ridiculous. Any suggestions on how to deal with this type of situation would be great.

I know what you mean, and I can understand how confusing it can be but I honestly cannot give you any advice because I have never gotten a refusal. Based on the post I have read from this forum, they do give a date on when you should leave canada but I am not sure how it works.

Though if she will be applying for permanent residence in-land, it would be best for her not to leave canada
