Hello,

My mom's profile:
> Supervisa application submitted on May 09, 2018
> Multiple Entry Visa approved on May 16, 2018, valid until May 09, 2028.
> Entry (Toronto) on June 15, 2018.
> E-ticket date of departure from Canada: December 9, 2018.

Regarding Extension:
> Submitted on October 31, 2018.
> Applying for extension til April 28, 2019 (Aunt will go home too, planning to buy same ticket for next year)
> Current application status (as of Nov 1, 2018): "We are processing your application. We will send you a message when there is an update or if we need more information from you."

Could you please provide some insights?

1. As processing times for extension application varies (+/- 100 days on average as per CIC?), this application might give mom implied status. is it safe to assume this, so I can cancel the December 9 ticket?

2. Given my mom gets the implied status, if there's no decision yet come April 2019, she can still book a flight for Apr 28? Will this just void the extension application? How will this affect my mom's record (will it be overstaying for 4.5 months, or no case there since it's under implied status time frame, etc.)?

After this visit/extension, Mom's not planning to come back til June 2020.

Thanks!

Yes, she’ll be on implied status until the decision is reached, and leaving Canada before the decision voids the extension application.

Wait...was she granted a PG-1 visa or a regular TRV? What date was written for her length of stay at the POE?

^ Regular TRV. Entry date was June 15, and no date stated. I'm assuming it is December 15. It's a little weird because if we apply just for regular TRV using the documents we submitted last May, it will not even meet TRV's requirements.

Do you know what will be in her record for the time she spent waiting for decision (December 15 to April 27)? Correct me if I'm wrong but I'm under the impression that if they void the extension application, the implied status will be voided as well, and the 4 months she spent waiting for CIC's decision will be an issue in the future.

I’m not too familiar with extension applications, but I believe you should get a decision in less than 4 months.

I think that will only be an issue if she attempts to reenter Canada so soon. If you say she’s going back to Canada in June 2020 after this stay, then 4 months of implied status (again, I don’t think it’ll come to that) wouldn’t be an issue.

She will be give guidance when she receive the response from her visitor extension. Even if the extension is denied it is not considered an overstay if she leaves based on the deadline stated in the refusal.

Implied Status won't be voided if she leaves while the extension app is processing.
