I am an Indian married to a canadian.
I have been on a student visa in Canada since Dec 07, expires in Sept-09
Only been to the US for concerts/transit. NEVER stayed there (student/work etc)

I was gonna apply for PR through the outland process - i.e. to my home country (india) but someone told me the following:

"If you were admitted to Canada for 1 year on your original entry, you also can apply to Buffalo. But if you don't have a US visitor visa you will be taking a chance if an interview is required"

Can I apply through buffalo?

i suggest no coz if they call u for interview u wont be able to go to u.s unless u take the visa well apply for in canada process

Thanks Siki......I have a US visitors visa till Aug 09 so I can make it to the interview.

The only thing i am wondering is Can I actually apply through buffalo? And if yes, I cant find it on the cic website....

any help will be appreciated :)

If you were applying for FSW and you are in Canada, your application could go through Buffalo but if you are applying for spousal sponsorship, you can not apply through Buffalo unless you are legally staying in the US. You have two choices of sponsorship, inland and outland. Inland you apply as living in Canada, your application is completely processed in Canada. You get first stage approval after 5 to 6 months and can then get an open work permit if you apply for one. Your PR could take a year to 18 months. Drawbacks with inland, if you are refused, there is no appeal and you are not advised to travel while it's in process since if for whatever reason you are refused entry to Canada, your application would be gone.

Outland you can get processed in your homeland or other country where you are living legally. In that case, the sponsorship approval is processed in Canada taking right now about 35 days, then goes to India and right now taking average 4 months there. After that you get PR but if they want an interview, you would have to go to India for it.

Then how do explain this notice on the Buffalo Web Site?
