Very Urgent:4 Years Cap complete,can I take SINP and continue to stay in Canada

I am looking for advice on the following scenario.

I have applied for AINP and not yet received any nomination but an employer from Regina, Saskatchewan is offering me SINP for Food Service supervisor but the issue is that I have completed by 4 years cap and my current employer has applied for an Restaurant Manager LMIA and we are still waiting for an outcome on the same.

My question is will it be possible for me to apply for Provincial Nomination in two different provinces and can I still stay in Canada if I take up the SINP.

Hi,

you can not apply for provincial nomination program in two different provinces,its totally impossible.as a PNP applicant you are suppose to be expressing your interest to settle in such a province after you become a permanent resident.if you decide to move to saskatchewan your alberta application will be definitely rejected on the basis of not showing intetion to settle in their province,i would suggest you wait for your AINP because even if you move to saskatchewan you will not be able to get a work permit if you have reached the 4 years cap and even though you might get a positive LMIA for a restaurant manger in alberta you will not be able to get a work permit because you have already spent 4 years in canada and CIC is aware of applicants who will try to switch to management positions so the can stay in canada.
if your work permit expires before you get your AINP certification unfortunately you will have to leave canada or apply for a visitor or student visa for the next 4 years before you become eligible for a work permit again.
also if your application for the AINP is employer driven then once your work permit expires the application will be closed unfortunately.

Hi,

you can come back to canada anytime if you become a permanent resident and in the case of provincial nominee i think you are exempted from the 4 years rule,i would suggest you cantact cic at the toll free number and ask them about the exemptions to the rule.you can also contact AINP and inquire about your file status and if you can get an urgent processing based on your situation but im not sure if they can do that.
