VERY LONG DELAY FOR H&C

Hi all, i have a few worries for my H&C application. When i arrived in Canada to claim asylum, a border officer insulted me and said "they will fuck me up". refugee claim never went through. January 2015 i submitted an H.C application. the ecas says in process since then. i did some gcms notes and it says my application was stuck in security.. for 3 years!! and recently they contacted me and asked me to do DNA test to prove that my 2 kids back home are mine. DNA done and proved that they are mine. now i dont know what is keeping them to approve me. or they are not happy that dna proved them wrong ? as they might thinking to fuck me up as the border officer told me.. i did complain to minister of immigration(no answer),minister of justice(no answer),but the minister of public safety first replied to me that he instructed an internal investigation but they did not find anything wrong. (aka we investigated ourselves and we find that we did not find anything wrong we did). i then sent him another complain with details of abuses and mistreatement, and he never replied. now i dont know what to do, if anyone can help with positive ideas.

There are a number of things that can push an H&C application significantly beyond normal processing times. DNA tests is certainly one of them. Another is if the security review takes particularly long for the country or countries you have previously resided in - or based on your background (which can include things like where you worked, if you were in the military, if you were involved in particular organizations, etc). It's much easier for Canada to complete security reviews in some countries than others - there are some countries that aren't very cooperative with this process or where it's difficult to access records. Unfortunately the application cannot be finalized until the security review is completed. I honestly don't think anyone is trying to screw you over. It's the security review that's pushed the processing of your application over normal processing times.

Have you tried ordering your GCMS notes recently to see where things stand right now? That should at least tell you if the security check has finally been completed and if the DNA tests have been processed.

Hi, thanks for the reply. i did order the notes and im still waiting for it. the last notes i ordered around december last year showed that they received all informations they wanted for security from countries. country in war but i never been in army. by now they know it, and they switched to dna thing. they even refused to give me more time for dna tests(only 8 days extra). thanks to God, the dna went faster. now they acting slow again..

How recently did you submit the DNA test? Was that this year? It does typically take several months for the DNA results to be processed once submitted.

The agency (Genetrack) sent results to immigration 2 weeks ago.
Ah - in that case it wouldn't be surprising if you still have a few months to wait.

Even if the officer just gave me 8 more days... looks like she will decide in days..
That's just the submission deadline. It doesn't always mean the officer will make a decision immediately. However there's always some chance they will...

It's not bad to go to the media - however this won't speed up your individual case.
