Very Important : How to get back the original docs

Hi All,

please guide me, I am struggling to get the original docs back from Canadian authorities which was submitted with family class sponsorship for the last six months, the case has been finalized, but I didnt get my original docs back. My case was in canadian embassy abu-dhabi and there was an appeal also in our case, I wrote a letter to abu dhabi for the original docs they replied that they dont have original docs you have to write to appeal division I wrote a letter to Appeal division they replied they dont have the doc you should contact to CPC missisauga I wrote a letter CPC missisauga with letters I received from abu dhabi and appeal they replied my documents should be with abu dhabi as all the docs goes back to the VO. I wrote one more letter to abu dhabi with the letters I received from CPC mississauga and appeal division stating that I should contact abu dhabi, again abu dhabi replied that we dont have your original docs because your file was sent to appeal division.

kindly somebody guide me how to get the original docs I have already contacted Abu dhabi, appeal and CPC mississauga twice but unfortunately didnt get the positive response.

Oh dear sounds frustrating..perhaps somebody doesn't realize they have the documents? Or cant tell the difference between an original and a photocopy? Were they really Important? The only original we sent was my Husbands Notice of assessment for his 2009 tax return..but not too bothered about it we can request it again! I hope you find them in the end..does Immigration keep the whole file after your case has been finalized?

Thanks for the reply, actually we submitted original birth certificates and marriage certificate, now I dont know how to get my original docs back.

My guess would be the appeals division didn't realise they have the originals. Did you spell out exactly which original documents it is you're looking for when you wrote to them?

well it depends on what part of your appeal process your in. You said it was finalized, does that mean you have the visa in your passport now?

I know we kind of had the same problem after we won our appeal. The documents (oringinal file)get bagged up from the appeals board and then they wait to be send by diplomatic mail. That can take time depending on what visa office you deal with. In our case it was delhi. It took about a few weeks for our file to arrive in delhi office. No one seemed to know anything during those weeks. Appeals board didnt have it, CIC miss. didnt have it and Delhi didnt have it. March we won our appeal and June they started working on our case. Once your file leaves the appeals board they dont have your documents,(maybe they keep a copy I dont know) it goes directly to the visa office all original documenst and to my knowledge all pictures and such are sent back to you from the visa office. The appeals board send your original file back to the visa office along with the appeal allowed letter. To my knowledge appeals doesnt touch your file again its the visa office.

The same thing happened to me and my original documents. I phoned and wrote letters to the appeal division - they said they don't have them anymore, that they've been sent back to the visa office that originally processed the file. But this office claims not to have them either!

I think what happened is that the documents were in transit between the appeal division and the visa office when the OP made his enquiries. So I would continue to write and call the visa office in Abu Dhabi; the documents should show up there eventually. If it takes too long, definitely complain in a formal letter to CIC and your MP. They may not be able to get your docs back, but such disregard for our important papers should be brought to the government's attention.

@ boyee; we took back the appeal in March 2010 since then I am chasing these guys for my original docs, I called Appeal division they said they never get the originals from Visa office they always get the copies but as visa office is saying that the whole file we sent to appeal division means that it should contain originals as well but I dont know why appeal division is saying that they dont have originals.

@ canadianwoman: are you still chasing for your documents and for how long you are chasing them.

I am very sorry to hear of your problem. Have you tried contacting your local MP? Sometimes they can find out things you and I cant. Thats what I did.

@ boyee, Yeah I have sent a formal letter to MP office along with all the responses I received from Appeal, VO and CPC mississuga, even I have sent a formal letter to the minister's office. I have not received any response from MP and Ministers office yet, there way of work is very unclear and confusing in all the matters, lets see what happens next.

I'm still trying. The appeal was on July 6th this year, so I am waiting a bit and will then contact the visa office to see if they have received them yet.

For an appeal the visa office sends the file to the Canada Border Services Agency, which then sends a copy to the sponsor and another copy to the Immigration Appeal Division. So it is the Canada Border Services Agency that has or had the originals, not the Immigration Appeal Board. They are the ones who supply the government lawyer who argued against allowing your appeal at the appeal hearing. But I contacted them, and they told me they had already sent everything back to the visa office, which apparently hasn't received it yet.
So in your case try contacting (by letter and phone) the Canada Border Services Agency office that handled your appeal - it should be listed on the appeal decision.

They responded very quickly - I got a phone call from someone in the office about three days after they received my letter.
