Very desperate for advice. Iranian government wont issue a birth certificate for my child

Hi everybody,

Short story, Iranian government refuses to issue my child a birth certificate. I have gone through a few thousand dollars and about 7 months just to legalize, translate and send Power of Attorney documents to Iran... All for nothing.

They refuse to give my daughter a birth certificate because her dad is a Canadian and supposedly a threat to the government. What do i do now? How in the world do i prove to IRCC that my daughter even exists? I want to add her on to my wifes sponsorship application and apply for her citizenship, but we have 0 documentation except for the hospital birth record. This is not a good situation for my daughter.

A DNA test is pretty strong evidence. I would get the DNA test done, then write a letter of explanation explaining why you can't get the BC. If you have evidence (emails, letters) that show the efforts you went through to try to get that done, include those. Basically show that you did everything possible to get the BC and failed. This is a pretty unique situation. Having said that, my husband was approved without having one PCC for a country he lived in which was impossible to get. We wrote a letter explaining the situation and provided evidence of the efforts we'd gone to for many months to try to get it done. If you can find any information on a government website that backs up your situation, print that out and include as well. Definitely include the child as a dependent in the application.

Further to my post above, see this. I didn't read the whole thing but it may support your position. I think the shenasnameh is the BD?? Anyway, not sure this supports your postion but try to find stuff from foreign government sources that does and include this with the LOE (along with the DNA test results).

2.1.1 Children of an Iranian mother and a foreign father Since 2006, children with an Iranian mother and a foreign father have not been issued a shenasnameh. This group has had to apply for citizenship after turning 18 if they want to become Iranian citizens (NOCR, meeting in Tehran November 2011).3 In October 2019, however, a law was passed allowing Iranian mothers married to foreign men, to apply for citizenship of their children before they reach the age of 18 (HRW 2019). Thus, the transfer of citizenship from mother to child does not take place automatically. The condition is that the parents pass a security check (CHRI 2019).

Apologies if this is a stupid question, but is the child still in Iran?
No not a stupid question at all, the child is still in Iran yes. They say that they would like for me to come to Iran to be interviewed, but my wife and her family say that its a very bad idea as I am a Canadian (non-iranian heritage, born on Canadian soil) and they view me as a security threat.

Good luck. I would actually do the DNA test yourself / without waiting for the letter to be issued (assuming that's possible). Sorry for not making that clear earlier.
