Dear All, I am on an Open Work Permit and received a full time offer from a Company here in Canada. However, this offer does not have a LMIA number.
Can i consider this job offer as a valid job offer under Express entry profile? Please advise.

No - this won't be classified as a job offer under Express Entry since you hold an open work permit. The employer would need to obtain an approved LMIA in order for you to count this as a job offer and be able to claim the 50 points.

a) Full time offer, non- seasonal
b) Valid LMIA number OR
c) Job is exempt from needing LMIA

So the job offer mentioned above will not fall under point c? Kindly advise.

Answer is still no.

What you have quoted is not the full list of requirements. One of the additional requirements if the job is LMIA exempt is that you are on a closed work permit where your employer is named in the work permit and have worked for that employer for at least one year. Since you are on an open work permit, your employer is not named on your work permit and you don't meet this criteria. Your employer needs to obtain an approved LMIA if you want the 50 points. Otherwise you're out of luck.

No. "Job is exempt from LMIA" refers to jobs that fit the provisions of immigration regulations 204 and 208, which a PGWP does not.

I would have a question too about the job offer and this topic seems closer for a simple question than I open a new one.
I already understand the requirements for a valid job offer what you talked above, but I don`t understand exactly this sentence:

"The offer from the employer should include the following details [...] commitment that the applicant will be employed on a continuous, paid, full-time work, for work that is for at least one year after issuance of a permanent resident visa."

So if I understand well it is not enough if I get a one year long contract offer from an employer (My profession works with temporary contracts), it should be one year long from that point from I get the PR status? Because in this case it should be at least one and a half year long (best case scenario), but its hard to determine when I get my PR from that point when I apply for it isnt? I just would like to clarify, so I would welcome any advice.

Your employer needs to provide you with a letter that states they will continue to employ you full time for a year after you become a PR.

• I'm an SINP nominee holding an open work permit (IEC work holiday visa)
• Work full time/NOC A/permanent job for a tech company that's supported my SINP application
• Will be obtaining a new, closed work permit based on an SINP Work Permit Support Letter that came with my nomination
• Will be completing 1 year with my company soon

Will this count as a "valid job offer" for +50 EE points when I hit the 1-year milestone?

And if so, am I able to apply via Express Entry given if I've already sent off a paper PNP application based on an SINP nomination?

To the best of my knowledge, tt will only count as a valid job offer after you have worked for the employer in Canada on the closed work permit for one full year. Basically you'll need to start the clock on the 1 year once you hold the closed work permit.

This is definitely a complicated one as there are so many conditions. Another immigration consultant friend said that as long as I do the one year with a combination of an IEC visa/closed work permit that would also suffice, so long as I worked for that employer for one year.

Do you think it's worth trying to apply anyway? If it turns I'm indeed not eligible, I take it they would simply return my application? I don't want to wait potentially 28 months for a PNP application to be processed if I can avoid it.

If you aren't eligible, they will refuse the application (not return it) and you'll lose some of the application fees.

i will not be amazed if it was fake, but i check everything and it sound legit, plus the person used to live with me but had failed refugee claim, so he went out and i am still waiting for a year now, i checked the original passport by investment for St. Lucia is $150.000 but i don't know how he got it for $36.000. yesterday i chatted with him on whatsapp video call, he is as happy as a bunny, i am assuming somebody corrupt in the government selling passport for cheap because these small countries have big corruption problem.

The downside with this is that he will really never be "safe". I mean it's quite obvious the passport was obtained fraudulently. Regardless of how that happened, there's certainly a chance this could be uncovered and the passport revoked at any point in the future.

So he'll need to live his whole life knowing this might catch up to him at some point, he may lose citizenship, and then be forced to leave the country.
