Vacation after IEC

Hi all,

I posted this question about a month ago but realised I didn’t provide all the info so apologies for repeating myself. I’m concerned I’ll be denied entry at the border when I travel to Ottawa next weekend.

Background

- From 2016 to 2018 I have an IEC visa
- I applied for a BOWP (not realising I couldn’t) and was refused
- I left Canada a couple of weeks after my IEC expired (October)


This Visit

- I DO NOT intend to overstay the two weeks, my intention is to marry my fiancé and return to the UK to start Outland Sponsorship
- I have a return ticket
- I have a letter confirming my approval for two week vacation from my job
- I have a letter from the NHS confirming I am undergoing a gender transition in the UK (this is why we’re applying Outland)
- I don’t have a hotel booked, will this raise a red flag? I intended to stay with my fiance
- Since I started transition, my passport name and gender have changed since my IEC, will this be an issue?


Will this be enough to convince the CBSA that I am here for a vacation only? I am aware I should only offer info that I’m asked for. I’m just worried my previous travel history in Canada and the fact that I’m coming back so soon will cause me to be pulled straight into secondary and result in refusal. I intend to tell them that I’m here on vacation and to collect the remainder of my things (this is true, my PS4 and clothes are still with my fiancé and I miss my gaming!).

Does anyone have any advice?

IMO you should have no issues entering given you are from a visa exempt country. In addition to the vacation letter from your job, I would also bring evidence of payslips and also other ties (e.g. property ownership or rental). You probably won't need these - but it's a just in case. If you are staying with your fiance, then it's reasonable that you don't have a hotel booking. Gender change shouldn't be a factor at all. Make sure you also have proof of funds evidence (e.g. bank statement) that shows you have money to fund your visit to Canada.

Applying for the BOWP wasn't a great decision since you didn't qualify for one and this puts a refusal on your record. However I think the chances this will impact your entry into Canada are low. Hopefully you stopped working as soon as your IEC expired. If you continued working after your IEC expired and are asked about this at the port of entry when you visit this time - you should be honest about this illegal work.

Hi!

Thanks for your reply! I can definitely provide payslips but unfortunately proof of my job and proof that I'm currently undergoing gender transition through the NHS are the only 'ties' I can prove as I am currently staying with my parents following my return from Canada in October.

If I'm asked who I'm staying with, would it be wise to say 'fiancee' right off the bat or would I be better saying friend? I don't want to lie but at the same time don't want to open myself up for further questioning.
