Using Canadian Work Experience to Partially Meet Work Criteria for FSW

Hello everyone,

I'm new to this forum (and to the world of Canadian immigration), and I would be very grateful if someone could answer my questions related to the one year continuous work experience to apply for the FSW program.

Just some background: I'm currently working in the U.S. on a temporary visa. I graduated college in America in May 2015 and started working on September 14th 2015. I am authorized to work until July 23rd 2016. Clearly, I won't have met the one year requirement to apply for FSW by then. However, my current employer is willing to transfer me to Canada (my employer is a large financial services firm with offices across the world) once my current U.S. employement authorization expires.

Given this situation, I have two questions:

1 - will I be able to count my time in Canada as part of that continuous one year of employment? That is, given that I'll have about 10 months of work experience in the U.S. before I leave, can I apply for the FSW program after about 2 months in Canada? I'm a little confused because I got the impression reading some of the threads here that FSW only counts foreign (ex. Canada) experience toward the one year requirement

2 - If indeed I'm able to count my Canadian work experience as part of that one year continuous employment, how long can the gap between my U.S. job end date and my Canadian job start date be in order not to violate the "continuous" definition for employment?

Hi johnbell,

I believe, FSW counts foreign work experience only. If you work in Canada, you might qualify under Canadian Experience Class (CEC). But as far as I understood it requires a year of full-time work as well. Try to read more about this stream to understand your chances.

I don't believe it's foreign work experience only. I was selected for the FSW stream even though I also qualified for CEC. My skilled experience was Canadian only - none from my home country or any other country.

One of the requirements is that the experience must be at least one year and in the same job. I don't know if IRCC will see it as being in the same job if you transferred to a different country after 10 months. Also, on what basis would you be able to work in Canada? Is your employer planning to apply for an LMIA for you? If so, these can take several months to be approved. Or do you qualify for another temporary worker visa?

It wont affect anything. FSW requires 1 year full time experience without any breaks and under the same job and NOC code. I am not sure how the payroll and other stuff work for you. Just make sure you do not change your Job title etc etc .

I am not 100% sure :)
