USA Visitor Visa Cancellation, will it cause an issue in PR application

Hi,


We are from India and we are planning to start the processing for Canada migration. Before that need to know whether we can apply for PR. My husband has been barred from entering USA for 5 years. He had B1B2 visa. He has visited USA 2 times and stayed there 5 months each. 3rd time when he went there (after a gap of 3 months), the immigration people stopped him, his visitor visa has been cancelled and send him back to India (they thought that he has gone to work in USA). So if we apply for Canada PR now will this be an issue? Do we need to show or hide this incident. Please advice.

Do not hide anything because one you are invited to apply for PR, CIC will do a thorough background check. The question is not asked on the Express Entry profile but will be asked when you have to apply for PR after you are chosen from the pool.

The US and Canada share information. I think it would be more of an issue if he was trying to get a tourist visa to Canada. Since it's PR it might not be a problem because it's understood that he'd be moving there, not just visiting.

If it is stamped on passport, it can be a bit of problem but u can give good explanation to that when you apply for PR. Be frank and say truth that is all immigration like.

I know this has happened to a person I know, it does create problems and you have to mention it on the Background Declaration form, the ONLY problem it creates is that if the normal processing time is suppost 4 months for an application, they would take 8 months to process it , as they will give your application to CIC Los Angeles to process and they will try to connect with US Authorities.

The other option is to hide this information, but if you choose to do so, there can be bad consequences later.

I would suggest to openly declare it, and let them take time for processing. As far as US/Canada sharing of information is concerned, I should let you know that Canada does share all of its information with US, but the vice versa is not true.

As my friend got his US Visa cancelled and Canadian authorities did not seem to know about it, unless he informed to them himself.

Received the much awaited Copr on 18 December 2017. We had mentioned every detail regarding the USA visa cancellation on the pr application. It did delayed our application process but in the end we received our Visa. So be frank, don't hide anything from cic and you will get your Visa.

How long did your application take? My sister and her husband are in the same situation
