USA Outland Applicant Questions (Part 2)

Hello, I am a US citizen and being sponsored by my Canadian wife to become a Permanent Resident. I submitted an outland application in May and have some questions I was wondering if someone could help me with:

1. I will be moving in July with my wife and young children (app submitted for dual citizens) to the Toronto area. I have already been advised from this board not to move all of my items up there as it will be a red flag however, will it matter if we have a moving company takes all of our items (2 bedroom apt) under my wife's name and not mine?

2. Once we fly to Canada, I plan to have a round trip flight back at a later date. Do I then tell the boarder agents that I will be in Canada for an extended period of time and request a Visitor Record? With this in mind, I already have a trip planned in October to go to Mexico and Miami for two separate trips.

3. Under a Visitor Record, I understand I can only be in Canada for 6 months. Is that 6 month duration accumulative for the year or does it restart every time I leave the country and then come back.

4. Since I have applied as an outland applicant, I have been told I cannot obtain a work permit. However I have had conflicting advice and it has been brought to my attention that I might be able to obtain a work permit under DUAL INTENT. Can anyone comment on this?

1. Should be OK under your wife's name.
2. Sure - you can do that. Keep in mind that re-entry to Canada is never guaranteed if you leave. However as an American, you will most likely be OK.
3. Depends on what happens at the border. Sometimes you are allowed back in on your original visit and sometimes you are given a new six months. You can always apply to extend your stay from within Canada if you have to.
4. You do not qualify for an open work permit. You would only qualify if you had applied inland. No OWP is granted to outland applicants. There's no open work permit rule connected with dual intent - whoever told you that doesn't understand Canadian immigration rules. If you secure a job offer in Canada in an occupation that falls under NAFTA, then you would be able to apply for a closed work permit with that job offer and without obtaining an LMIA first.
