Dear all,

I need your advise, if I can claim as an asylum at the Canadian borders.

Just let me explain my story, in order to enable you seeing the clear image.

We are three family members.
1- My wife had an Israeli residency, and holding Jordanian travel document. She is a professional doctorate in Higher Education from a UK university , and her major is Physics.

2-I am Egyptian working in Qatar as legal manager. LLM
3-My daughter is 2years old, special needs, down syndrome. Egyptian born in Isreal.

Since our marriage, we did not stay in Egypt more than 10 days, as the Egyptian Immigration Authority has rejected my wife’s residence application for 2 times, based on her nationality (Jordanian Travel Document without National Number) as an Israeli resident.

- After we got married, we moved to Kuwait, and stayed for more than 10 years. Thereafter, on Nov 2015, I have been offered by my current company, in Qatar, a good job offer as a Legal Department Manger over 63 companies.
- I accepted that offer, and moved there. I did not realize that I would encounter a serious problem with my wife’s residence visa application based on her Travel Document and nationality as well. However, after several attempts, barely, they accepted granting my wife a visit visa for 3 months period only. My wife was pregnant, IVF, when she came to Qatar.

- Within her staying with me in Qatar, I have submitted a residence visa application for her, but the National Security of Qatar Immigration rejected the application. Further, I have tried extending her visit visa because of her pregnancy; also they have rejected the extension application. Therefore, she had to leave Qatar to Israel, as a visitor not as a resident anymore, in order to get her mom’s support within my wife’s pregnancy, and ,of course, without any national health insurance coverage, because she lost her entirely residence rights in Israel as she has stayed out of Israel more than three five years.

- On Oct 10, 2016, she has delivered our daughter. We have been informed that Maryam is a down syndrome. We paid more than 5,000 US$ against the hospital expenses and the health care.

- We have started to communicate with the Egyptian Embassy in Tel Aviv, in order to extract Maryam’s birth certificate by the Egyptian Authority, and the passport accordingly.

- We applied for the said certificate, and the process has taken more than 7 months. within this period I did not see both of them, as I cannot go to Israel, otherwise, I will face a serious issue with the National Security of Egypt. Thereafter, we applied for the passport, but they informed us, 10 months later, that the National Security has approved to issue a travel Document only, in order to travel to Egypt, and then we can apply for the passport. That means that the process times had taken more than 18 months until we got a travel document.

- On Dec 2017, I have traveled from Qatar to Egypt, through Jordan, as a Transit because there is a boycott between these two countries, so there was no direct flights from Qatar to Egypt.

- I have commenced my daughter’s passport application, and as before, it had taken more than 4 months, while the regular process time for any passport taking no more than (3) three days. Furthermore, a regular passport validation period is (7) seven years, we surprised that the Authority of Immigration granted my daughter only (1) one year. Beside all this, they informed us that she would go through such time process every time, because her birth place (Israel). Moreover, whenever she travels from or to Egypt, they will keep us/her waiting for more than (3) hours at the airport for checking and investigation. The Officer of the Immigration Authority said to us that this is a standard procedure towards any Egyptian has any connection with Israel.

- After my daughter’s passport has been issued, I wanted to let them join me in Qatar. Therefore, I have submitted two visit visa applications for both of them, and because of their nationalities, the process has taken more than a month, and later the Qatari Immigration Authority approved the applications.
- On June 2018, I have applied two residence applications before the Qatari Immigration Authority, and after huge efforts exerted, unfortunately, the National Security, because of their nationalities, has rejected the both applications.

Current Situation and Actions Taken


- My wife and daughter should not stay in Qatar no later than Nov 4, 2018, as their visit visa will be expired, and there is no place for any extension.

- My daughter, after the aforesaid date, will not be able to travel anywhere, because her passport validation will be less than (6) months (May 2, 2019). Therefore, the only place she go is Egypt, which is considered an issue for my wife.

-We have, valid US visas, B1/B2. My friend suggested that we can go to buffalo and claim as asylums at the Canadian borders.

Based on the info, facts, as a family we can't stay in one country together Permanently.

To be a refugee you have to be in fear of your life and suffer persecution. I see nothing of this in your profile sorry
 
Are the said facts considered a violation of the Human Rights Grounds?
sorry to tell you that but the judge will refuse your case so easily cause I don’t see anything serious , comparing to the real refugees who really in need of protection your case is nothing but you seeking a better life and health care for your kids
I’m not saying that’s wrong it’s your right for sure but you don’t qualify for the refuge process
My advice for you since you and your wife are educated apply for immigration visa to Canada

However, I have already an application to canada, under process, under the Express Entry program.

My issue is My wife has no country to go and stay now. She is rejected from Qatar, Egypt and recently from Israel.



And really, it is not about better life only which I am looking for now. Simply I want to be stabilized with my Family. Thats it.

What is your wife's citizenship? Why doesn't she go to Jordan? I agree this isn't a case of persecution.
 
My wife is an Aarab Palestinian who was living in Jerusalem, Israel. She was had a permement residence. Such people, Jordan has an agreement with Israel to provide them with a temporary travel document, without Jordanian national number, to travel around the GCC countries, such as Kuwait or Qatar or Dubai. That means that she is not a Jordanian in the first place. She can visit Jordan and stay for one month only.

1. Given the time you are together, did you check the possibility for her to be naturalized as a Egyptian citizen (since she has married one).
2. Did she try to straighten up her status in Israel (and how to get their citizenship)?
3. Qatar or Kuwait have nothing to do with it. Those are 3rd countries who have their own rules. For them you are foreign citizens.
4. That procedures might be lengthy, is annoying, but that in itself is not seen as a case of refuge. (especially if their are standard procedures and parts of security checks).

In reality, you are most likely worried that you might not be able to pass through Express entry (where you actually belong to). And this is either because of not having enough points or because of being worried that you will be rejected under excessive medical demand.

Here is what will happen:
1. On the border you will be rejected right on the spot and asked to claim your file in USA (based on agreement with USA).
2. You have only mentioned that your wife has tried to get residency in Egypt more than 10 years ago but not now. It is a long time for a change, plus I do not see any effort to challenge that decision on the basis of a family reunion.
2. You did not mention that you have ever tried to stay in Israel or Jordan?
3. You are claiming that your wife is stateless, yet she was able to study in UK (unless her university studies were distant studies). How was that possible? Which citizenship did she use to travel there?
3. if ever you will try to claim refuge you will be rejected and that will mean that you will have problem for several years to get visa in most of the Western world.

There are Palestinian people in all the surrounding countries they can't all be illegal? What about returning to Kuwait? or another Gulf state? Assume it will be difficult to get legal manager jobs in Canada.

I also find it strange that a Palestinian woman can't remain in Egypt with her Egyptian husband and children..

Short answer : Unless you have family in Canada, you will be rejected because of the Canada-U.S. Safe Third Country Agreement.
