Us visa application misrepresentation

Please I need your advice and way forward.
Last year January, I applied for a USA nonimmigrant visa to attend a conference. I applied as married cos as at then I had had a mini traditional engagement done. Shortly after, the wedding did not hold and we went our separate ways. Also, the visa was denied. Now, I'm still single and I will be entering the pool for Canada express entry. I know background checks will be done. I can't apply as married as I have no legal documents for marriage and since the actual wedding didn't hold I can't file for divorce. Please, which status am to choose in the ee application?

I had a traditional marriage as well and applied for a US visa as married. I applied as married but explained traditionally when I came to Canada as a student. It didn't work out and luckily for me, there was no court or church wedding and the traditional marriage was never registered so I don't have anything to prove.

Since my bride price was returned which signifies dissolution of the said traditional marriage, I have been making all visa applications as Single. I have applied for my PR as single with statutory declaration as single. Also attached affidavit of return of Bride price from my dad saying that it has been dissolved.

My exact explanation on my LOE
"

In my application for permanent residency, I recorded my marital status as single as there is no other option that best describes my situation for the following reasons.

I was married according to the native and customary laws of Imo state Nigeria to the father of my daughter on May 7, 2011 as I previously indicated when I applied for a study permit in 2014. A marriage certificate was not issued for this nor was it recorded in the state marriage registry. According to the native law and custom, bride price is paid to the bride’s family which is returned to the groom’s family at the termination of the marriage. Following a breakdown of my traditional marriage, in 2015 my family returned the bride price to the groom’s family thereby dissolving the traditional marriage. I have attached a copy of the dissolution letter and affidavit sworn by my father acknowledging return of said paid bride price.

As my marriage was not a legal one, not registered nor recorded, I do not have official divorce documents to claim divorced nor legally separated, thereby my claiming a single status. "

This is not a misrepresentation. It will be if you don't mention you US visa refusal. Please make sure you do.

I will definitely mention the refusal, I needed to be able to explain the discrepancies in marital status and this explains my situation.

Hey, I pray you receive favour but don’t worry too much about it just apply as single but it is important u state your USA visa application denial, you don’t need to explain if married here or there. You single now and apply as single . I repeat don’t hide the fact that you applied to US and was denied. Wishing u all the best

Hey, I pray you receive favour but don’t worry too much about it just apply as single but it is important u state your USA visa application denial, you don’t need to explain if married here or there. You single now and apply as single . I repeat don’t hide the fact that you applied to US and was denied. Wishing u all the best
I didnt have a refusal

My eligibility is passed just my background check going on. There was no issues with my status.

I submitted the dissolution letter my dad sent to guys father after the bride price was returned.
My dad also swore an affidavit that there is no legal marriage between me and the man.
I also submitted an affidavit that I was never married legally in church and in court.
