I am a United States Citizen who plans to use a visit her Canadian fiance and get married. We have been together for 6 years and we have planned a small ceremony here in the United States for my family. If we got married in August and I came back to the US when my Visa expires in October would he be able to submit the paperwork to sponsor me if I'm leaving and then coming back to stay permanently in November?

I want to help but I am unable to understand certain parts of your post.

(1) I am assuming you're in the US right now (since you said you plan to visit your finance). In that case, what visa are you referring to? Is this a Canadian TRV? US Citizens (in general) can visit Canada for 6 months at a time (at the discretion of the CBSA officer), Visa free. So I am confused on why your visa would expire in October. Can you clarify that more? Or are you in Canada right now with an extended visitor stay?

In general, your Canadian (future) husband can initiate a sponsorship for you the moment you get married and have all the supporting papers necessary. If he applies outland sponsorship for you, you can visit him anytime and stay with him 6 months at a time. Let me reiterate the word "visit." When my outland application was in process and I entered Canada to visit my wife, I was clear that I was only visiting her and not staying permanently (although I was with her for months on end). If he applies inland sponsorship for you, then you can stay with him and apply for a work permit (other experts will chime in with regards to inland application.) So to answer your question, whether you're in the US or in Canada, he can apply to sponsor you as long as you have the supporting papers and proof.
