US Citizen wanting to live in Windsor while working in Detroit/Seasonal Resident

Hello,

I just recently accepted a job in Deroit, but would love to live in Windsor, ON. I have read about being a seasonal resident and its requirements (Lease of 36 months or buying a property). Has anyone here know of someone who has done this? Also, if this is possible, will I be questioned at the border if I have to go through the tunnel (Detroit-Windsor Tunnel) everyday? I am currently applying for Skilled Worker Category. Will this affect my application?

As a US citizen, you can visit Canada for up to six months - however you cannot live here. Immigration officials can refuse you entry into the country (even ban you) if they feel you are spending too much time in Canada (i.e. behaving as a resident rather than a visitor). I think going back and forth across the border every day would only work for so long - and sooner or later you would run into problems.

Wait until your skilled worker application is finalized and you have PR status in Canada before moving here.

Being a seasonal resident, see http://www.cbsa-asfc.gc.ca/publications/pub/bsf5082-eng.html#s3 with your own home or a 36 month lease only gives you the right to import furnishings one time without paying duty or tax. It does not actually give you the right to live in Canada.

As a US citizen, you may stay in Canada for up to 6 months a year unless immigration decides otherwise. That is, immigration can at any time decide that your intentions are not to stay in Canada temporarily, that you are a risk to overstay or planning to work illegally and then can decide not to let you in.

To live in Canada permanently, you need PR. If you were to decide that you want to live in Canada for up to 6 months a year as a visitor and cross the border every day, you should apply for a Nexus card because it makes your border crossing a bit easier.
