Hi, I have a question.
I am on open Work Permit in Canada and I have applied for my PR in Sep 2014, I am hoping to get my PR soon.
My fiance lives in states, he is on OPT.
We are planning to get married next month.
Is it possible while he is on OPT and working in states and I can apply for dependent Work Permit for him?
Or he has to come as visitor in Canada only then I can apply for his Work Permit?

Any advise would be highly appreciated.

You should repost your question under the "Family Class Sponsorship" of this forum!

All the best.

No. Read the original post again - it's not a Family Sponsorship question.

OP is on an open work permit and has applied for PR through an economic stream. OP's fiance is outside of Canada and OP is asking if his fiance can qualify for a dependent work permit. Neither of them are Canadian.

The best thing you can do is get married and update your application with CIC since it is already under process and a decision is awaiting. This ways you both can become permanent residents at the same time and you will not have to wait another a year or so for the sponsorship, which takes a toll on marriage.

You will just have to fill out few forms for him and update your generic application form and send it with his documents as required in the checklist. It will only delay the process by 3-4 months, but way better than waiting for your spouse for 12-16 months. Good luck!

Someone got PR visa and has not landed but visa expires in about 3 months time. If she gets married after getting the PR visa, what's the best way to include spouse?
Is it better to land and sponsor spouse or inform visa office since case is not complete yet but only decision made.

Also the letter from visa office clearly says change in marital status etc should be reported before one leaves for Canada.

The letter from the visa office is very clear about what you need to do if you get married. You need to follow the instructions in the letter.

If you land without declaring your spouse and adding them to your application - two things will happen: (1) you will never be able to sponsor your spouse; (2) you will be committing misrepresentation which could result in your PR status being revoked.

If she gets married after getting PR then sponsoring is the only option. Since the decision is already made it is no point now to include spouse. Just complete landing procedure and then sponsor the spouse.

Wrong answer. If the PR visa has been issued but the person hasn't landed yet - they must declare their spouse and add them to their application as either accompanying or non-accompanying. If they fail to do this and land without notifying CIC, they will never be able to sponsor their spouse for PR.

Not if they are still planing to marry and not married yet. There is a difference in getting married or already married.

But why the subject heading is "spouse immigration"?

What if one got PR visa and landed prior to marriage and completed all the landing formalities and returning back to home country and get married after an month or so ?

Then what would be the best in this case to sponsor a spouse
