URGENT: Sponsoring Parents from Quebec or Ontario

Hello everyone,

I am a permanent resident (living in Quebec) and I've already applied to sponsor my mom. My main issue is that I want to move to Ontario but the issue is the LICO/Income requirement. So since I've already applied from Quebec and according to Quebec rules, does me moving to Ontario affect the process? If it does, can I move there and then move back to Quebec prior to my mother coming to Canada? I really don't know what I can do but it would be SO dreadful if I have to start the process from the beginning again and wait 3 years to meet the LICO of Ontario (and all the other provinces)...

If anyone can advice me I would be SO grateful.

If you move, you'll put yourself at risk for being assessed under the Ontario LICO rules. If you want to make sure there's zero risk of this happening, you need to remain in Quebec until your mother's application is approved. That's the simple answer.

Scylla, So basically, I'll have to wait until my mom gets her PR which is like 6 years... Is there ABSOLUTELY no other way around this? So sorry to bother you, I am just trying to find something around this haha

Not really as Quebec will quickly find out you are a non resident as you have to state your residence when you do taxes. So if you go this route you will be committing fraud, CRA will catch on and so will a provincial government. Also you will have to change your drivers licence and health card over, DL after 3 months, health card I believe within 6 months.

Do you meet LICO numbers for rest of Canada over the past 3 years? The income earned can still be from Quebec.

As far as I know, when CIC does the financial checks (I think they do one near the beginning of processing and then again at very end), rules will be based on where you are residing at times of these checks. So if you're in Ontario at that time, they will most likely apply the rest of Canada rules. So at least if the final financial check is in 2-3 years away, you may very well meet 3 years of LICO by this time. But really it's anyone's guess.

CIC needs to be careful people aren't applying from a Quebec address just to take advantage of easier Quebec rules, but then not really living there. Quebec should really just match the rest of Canada, it's silly they have their own rules to begin with in this matter.

Correct - no, there is no way around this if you want to guarantee your application isn't refused. If there was a way around this then lots of people would try to cheat the system like you're trying to do.

True, if all rules were unified it would have been much easier, I would be able to move anywhere easily without worrying that the whole process has to start all over again. My income in Quebec does meet the LICO for the rest of Canada, that is why I am so confused. Anyway, I will have to consult an immigration specialist/lawyer in this and if all fails, I'll just stay in Montreal until my mother comes to Canada. Thanks a lot.

Anyway, thank you so much for your help, it is much appreciated. I will have to stay in QC until my mother comes here as you initially stated, its the safest choice.

If you meet the 3 years LICO requirements for rest of Canada, then there is no problem and you should be able to move. As I said, income earned in Quebec counts towards the LICO requirement no matter where you happen to be residing in Canada.

I doubt any lawyer would have a straight answer for you. Ask 5 of them and you'll probably get 5 different answers.

They count any Canadian income towards LICO. Doesn't matter what province you earned it in.

You just need to make sure you meet the rest-of-Canada LICO amounts based on your family size, which may be different from Quebec.
