Urgent residency question

I landed on may 7 2007 then returned to Usa in july 2008 but during my one year in canada i wasnt working coz was taking classes online for a usa uni.....am returning in jan 2011 finally n mmy pr expires in june 2012.....during my 2 yr stay in usa i became a naturalized us cittizen in july of 2010.......so do i briing both passports when i re enter canada and inform the IO? will i have problem renewing my pr n how early should i appy to renew....how may the want to to account for the first one year apart from the stamp on my visa?

Yes, you can bring both passports and inform CIC that you are also a US citizen now.

As for renewing your PR card, you can do it at any time as long as you have your 730 days (2 years) in Canada in your first 5 years as a PR. More is better so if you wait to apply until May 7 2012, you should have 2 years and 7 months. Under work history, write the truth, that you were not working but were taking online courses in a US college. If they want you to prove your time in Canada they will let you know.

Thanx Leon...... i was wondering if i can wait until end of 2012 to apply for my renewal as it will be 2 continous year living in canada BUT then will i be illegal in canada? As the pr wwill expire june ..... When i apply for jobs...do i present my pr or juust my sin n id....which documents r to legally presented? .....my other question is am bringing my one year old us born daughter ...should i let the IO know that i plan to sponsor her? Should i start working before i mmail the sponsorship paperwork or can mail it n later prove to them that i have a job n will use that to support her....thank

You're not "illegal in Canada" because your PR card expires. You could wait in Canada 10 years then apply for the PR card just fine.

A permanent SIN card (not beginning with the number 9) is usually all that's needed for jobs. I've never been asked to show my PR card by an employer.

Since your daughter is not a PR, the IO will almost certainly want to know your plans to sponsor her. It's OK to tell them you will be sponsoring her. Since you are a PR you must be in Canada to sponsor her; you can't do it while you're in the USA.

However, that creates a slight problem in that your daughter will likely be found inadmissible, since you plan to remain in Canada permanently, and so - by association - so does she. Usually how they resolve this situation (for a child of a PR born outside Canada) is to issue a Temporary Residence Permit. This allows the child to enter Canada despite technically being inadmissible. You then have to apply for her PR either inland (through the humanitarian and compassionate stream) or overseas, but specifically requesting H&C assessment and an exemption to overcome her inadmissibility. It seems that CIC usually advises PR parents to sponsor their children inland through H&C.

It is usually not a problem to take a visa exempt baby across the border. Do that and sponsor her as soon as you are in Canada.

As for the PR card, it does not matter if you apply in May 2012 or end of 2012, in both cases, you would have 2 yrs. 7 months in Canada in the previous 5 years before you applied and you need only 2 yrs. You will not be illegal in Canada. Keep in mind though that you will have problems coming back if you leave Canada and do not have a valid PR card and renewing right now takes months.

Thanx guys for ur detailed explanation....so now my question is should i sponsor her based on h&c or just sponsor her outland ....need ur advise...n is it advisable to start working before i start the process?

Doesn't really matter if you sponsor her outland or inland or if you are working. Because this is your child, you will not be held to income requirements to sponsor her.

I never get welfare. Is there no income requirements to sponsor my own 3 children & wife?
