hello Experts,

I came thru a case.. one of my roommate(in canada from last 1 year) and his gf(just came 1 week ago) came to canada.. both are on study permit for 1 year..
They are thinking of getting married...
What will be the probability of getting PR??
and if in case they have baby here.. will they get PR or Citizenship??

Experts advice required.

Just because they get married in Canada will not make them eligable for PR

The baby will be canadian citizen but the parents will not have any advantage and again it does not make them eligable for PR now.

No - no advantage.

Once the child is an adult the child may be able to sponsor the parents. But no benefits until then.

No - they can't stay and get PR just because they have a Canadian citizen child. The child is certainly allowed to stay. But they are not. Again, they receive NO benefits from having a Canadian citizen child.

They either misunderstood the lawyer or the lawyer doesn't know what he/she is doing.

One of them need to marry you -same sex marriage is allowed in Canada- than you can sponsor your spouse, get divorced (Canadian practice) marry your real love and finally sponsor him/her...

OR

Everything what was said about the child is right. Born in Canada it'll be a Canadian. At an age of 18 it can sponsor his/her parents for PR. Currently this is on hold but might open again.

Won't work for many reasons. One of them being that Harry22 is here on a study permit too and doesn't have PR.

The way to get PR if you are only taking a one year course:

1. Apply for an off-campus work permit as soon as you are allowed to (after 6 months of studies). The off-campus will allow you to get a part time job, up to 20 hrs. a week during the semester or full time on holidays.

2. Apply for your post-grad permit when you graduate. You can continue working on your off-campus permit after you graduate while you wait for your post-grad permit.

3. Make sure you look for a skilled position. Do not waste your time working low skilled positions.

4. Look into the PNP in your province. There may be an immigration class for graduates or workers with employer support, look into if you qualify for that. Apply if you can.

5. If your work permit is 3-4 months away from expiring, you need to think about extending it if you want to stay. If you have managed to apply under PNP and you have been nominated, you can ask the PNP to waive the need for an LMO (Labour market opinion). Otherwise, you will need to convince your employer to apply for one so you can apply for a regular work permit before your work permit expires. If you apply for a work permit before the existing permit expires, you are under implied status and can continue working. The spouse of a skilled foreign worker may apply for an open work permit based on the partners permit.

6. If all else fails but either you or your spouse have managed to work full time for at least 12 months after graduating, you can apply for PR under Canadian Experience class.
