Urgent query CEC work experience no. of working hours required??

Hi all..

I am working as an Assistant Accountant cum Book Keeper and my job duties includes book keeping,etc. which comes under NOC skilled job category 'B'..

I will be applying for PR under canadian experience class..i got my open work permit in 2010 and expires in 2013..

I have been doing nearly 60 hours a week recently and intend to do so in the future coz my boss wants me to work these many hours.I work for 6 days a week--a 10 hour shift..are there any limitations on the maximum number of hours worked during a week??In coming months my working hours will vary between 55-60 hours per week as required by my boss..i have done the calculations..by doing these many hours i will be exceeding 1950 hours of work experience by October end..

Now i am confused do i have to work for full one year menas 365-366 days or if i can complete the required number of hours for PR i.e 1950 hours within a time span of less than 1 year..would i be eligible to apply for PR??I have 520 hours of work(same job as an assistant accountant which i am doing now with the same employer) experience before i left for abroad..and came back to start my job in April..


Experts please throw me a light on this..

If you work at least 37.5 hours per week (or more), you are considered "full-time," and you need 2 years of full-time work experience (104 weeks).

(The "1950 hours" per year is only relevant to part-time workers who need to calculate their "full time equivalent").

If you are applying as a post-grad and only require one year of work, then please state that you are applying as a post-grad, and it is still one full calendar year (52 weeks) of full-time employment.

Agreed. If you are a student, you need 2 yrs. studies and at least 12 months of work and at least 1950 hours. If you are a worker, you need at least 24 months of work and at least 3900 hours. You can not apply sooner because you work a lot of hours.

A big thank you to Jess and Leon for their respective replies :)..

I have done 2 years of my studies with Diploma in Accounting from Humber College,Toronto.Right now i am working with an Accounting firm in Toronto.

I obtained my post graduate Open work permit in August 2010 and it expires in Sep.2013.

and Currently i am doing close to 60 hours a week as per my job requirements.I have done the calculations..I will be done with 1950 hours by the end of october.

Leon and Jess,i started my job in October 2010 and worked till November before i went abroad to my home country for marriage.So i have had 2 months of full time wrok experience before i left.I came back and resumed my work in April 2011..earlier i used to do 40 hours per week but now my boss wants me to work close to 60 hours a week thats 10 hours shift for 6 days a week.I assume looking at the workload i will be doing close to 60 hours per week for next 5-6 months as per what my boss said..

Now my first question:The gap of 4 months(going to my home country) from my job would it matter?..coz my total number of hours before i left was 520 hours of full time i.e. i did close to 40 hours per week than.Will this gap be acceptable to the authorities when i will file for my PR?..so this way most probably i will be completing my 1950 hours within 9-10 months of my work.Does it have to be i need to work full 365-366 days to be eligible for PR?? i am kinda confused or i just need to complete 1950 hours even if i am done with these many hours within less than a year to be eligible for PR.

Could you's throw me a light on this issue?

I shall be greatful.

You might get away with it then, if they look at your start date as October and 12 months from there. I honestly do not know if they have a problem with it. 520 hours in October and November is more than 40 hours a week though. It is more like almost 60 hours a week too.

Already answered. It doesn't matter if you work 40 hours or 80 hours per week, you still have to work for a full year (52 weeks).

As stated previously, the requirement is that you must work 1 year AND at least 1950 hours... 1950 hours is not a substitute for working a full calendar year.

It does not matter that you have a "gap" of 4 months, but those 4 months do not count, either (assuming it was unpaid leave). You have to complete your full year of work within 2 years, so you will be OK.

If you continue to work without further gaps, you will have to work until Feb 2012 (roughly) to qualify. Better to count the actual weeks worked, tho. Again, 52 weeks... (paid vacation counts as employment).

There are others on here who have made this mistake and had their application rejected. If you apply in October 2011 your application meet the same fate.

Thanks Jes..i think i got my answer to my previous query..

There is another query..kinda complicated..i got married when i was abroad..My spouse was deported from NZ in Sep.2006..but he had no intention to overstay in NZ..His passport got stolen..he even lodged a police complaint and has got a police report for the same.He than contacted immigration officials in NZ telling them what he needs to do.They informed him that his visa has expired and he needs to leave the country..Some of his friends wrongly advised him that he could simply hire an immigration lawyer and the lawyer will fill a refugee petition on his behalf..the lawyer used his money for nearly one year of his overstay period..he was just under the impression that we would be able to live in NZ coz of the false promises given by his lawyer..

Than nothing happened..my husband gave up and he approached an immigration official stating that he is overstaying in the country..the official arranged his deportation documents and he came back in Sep.2006..
Immediately after coming back to his home country..he paid the removal costs amounting to NZ$10,000 to the immigration NZ in his home country.Since than he had worked with number of MNC's.

Now what i want to know is when i apply for my PR application in Feb.2012, am gonna add my spouses name with my application.Will his overstaying experience in NZ that was nearly 5 years ago,will it effect my PR application? If not will he be allowed to join me in Canada?what kind of documentation will be required?

Please throw a light on this.

Overstay history is not an issue for PR applications because you can not overstay a PR :)

Thanks Leon...

Funny one ..he told his ex-girlfriend has falsely put an assault charge against his name back in 2004 or early 2005..he was never convicted though. Back than she told him she did that just to teach him a lesson coz he was seeing another girl at the time.

She is in Australia now but he was never sentenced for this charge..he doesn't know if that charge still is there..

Will this effect in his joining me in Canada??

Not funny, actually. I was about to suggest that you request his police clearance from NZ to find out whether it will appear on his record, but it appears that in the case of NZ the certificate does not go to the requester, but directly to CIC...
