Hi all,
Can anyone tell what to do in case one is separated for more than 6 years, already filed for divorce , but divorce is not yet finalised as the estranged spouse is absconding from the court appearances ? There is no information about the current whereabouts of that person and the legal notices are sent to last known office address .
What to attach in exhibit in this case where it is already declared as legally separated in the personal details section?
Any informed reply will be appreciated.

Thanks .

Attach copies of the official paperwork that shows the divorce has been filed.

Attach all the relevant documents that points to divorce and the following proceedings. If you still feel the need, consult with an Immigration Lawyer, he can iron out the next steps. Good luck.

Hi,
Thanks a lot for the reply. Spoke to my lawyer who said as proof , can submit the e-court portal report prints where the proceedings of the Divorce appeal till date is shown and also the fact that the person is absconding from the appearances. However, the name shown there is with the married surname which I never used ever in any form or any documents till date . My original appeal too doesnt show that married surname but I guess the data entry person probably assumed too much and put it that way while entering data. Now what do I do? Should I get a notarised affidavit separately for declaring the mistake in the portal or just declare it in LOE along with other declarations and get the LOE notarised totally?
