Hi guys,

Thanks for the wonderful work you guys are doing here, I got a refusal letter from my VO today on the ground that i did not submit any document to receive points for relatives in Canada, I actually submitted the documents my relative Fax to me from Canada but seems that was not enough. As a Nigerian, as at when our parents were born, married and even died, there were no records of any of this events which they requested to be part of my documentation but i went to Court to obtain Affidavit of Fact stating the family tree which didn't got to them b4 my file was reviewed. I also obtained Local govt of origin showing that i and my relative are from the same town.
To this end, what are you guys advice? are there room for appeal? or what should i do now?

I'm not an authority, but it might be faster in the long run to reapply and ensure that you include ALL documentation as required. If you are unable to include anything be sure to write a clear cover letter explaining why and what you have done to provide it. Don't leave anything to chance. The problem is, if you decide to appeal and that fails, you may miss out on this year's CAP. I am not sure what you would be appealing as the VO has to make a decision based on the information you provided. All the best.

Send a fax att'n to the program manager at your visa office asking that they reconsider their decision.

Quote their e-mail/letter to you and cite the proof you had sent. Attach a copy of that documentation and add, if you can get them very quickly, recent utility bills in your relative's name addressed to them in Canada and other proof they can fax you that they are Canadian residents (PR card, letter from employer). Also, explain the issues with getting the birth certificates and reiterate how you proved that they are your relatives.

Outline very clearly in a chart the number of points you have and show how you would reach the points if they granted you the points for a relative.

I hope this works for you! if not, as Pippin mentioned, reapplying is probably faster but you'll have to explain the additional info you are submitting so they don't treat it as an already-decided case and have you end up with the same scenario. You could also reach out to a lawyer to get expert advise on the possible appeal since I'm not an expert either.

If all fails, you could reapply.

MI5 is just 20 days ahead. You can withdraw this application by writing to the CIC and apply on July 1 agian. This is, if your application has not reached very far. I assume you are still at the application stage and you can take that chance...Also, this will be dependent on the NOC under which you applied. If thats not a fast filling NOC and you think will be there again in the new list, you can take your chances.
