Friends, Can you please advise me on my situation.
I have a valid WP and am currently working in Canada. My spouse is on a visitor visa it expired last month and have filed for her extension of stay before the expiry of her visitor Visa. Once her application is approved, I believe that she will only be issued a visitor record and not a visitor visa. Hence, I would need to apply for her visitor visa again. When I received my WP, my spouse details (Full Name, DOB, Relationship) are also printed on my WP.

My question is, based on my WP, can I go ahead and apply for a visitor visa for both of us? Please advice urgently.

Are you going out of the country (travelling...etc.) and returning afterwards?

If your intent is both of you to stay, your current WP allows you temporary residence until the expiry of your WP. Her visitor record allows her also to stay (temporary residence) up to its expiry date.

You both to do not need a visa to 'stay' in Canada - you need visas to enter/re-enter the country. The visa is a travel/entry document. The WP and Visitor record are 'status' documents and allows you to work/have temporary residence in country.

Yes, I need to travel outside Canada and come back. I really cant wait for my spouse visitor record/WP to arrive. Hence, can I just apply for a visitor visa from within Canada based on my closed WP containing details of my spouse?

If your WP is valid, you can apply a TRV from within Canada for yourself. That of your spouse is a different matter as she is a visitor. She may not be eligible to apply from within Canada.

I checked out the link and one of the point says that "your current temporary resident status is still valid, and your existing counterfoil is expired and/or was valid for only one entry. Since my spouse open WP and visitor record extension is in process, does it still mean that she has a valid temp resident status?

I interpret that as having to satisy ALL of the three conditions as that was what happened when I tried to apply for a TRV for my wife while she was also on a visitor record. She was not eligible so we had to apply for a TRV on the way back.

Your spouse is technically under implied status now, and does have valid temp residence status, but whether that is enough for the requirements of applying within Canada, that is unclear.

Suggest to call up CIC so you can get a better explanation on eligibility.
