Hey,

I am glad that I caught this before submitting and thought I should clear this with seniors here...

My job started from Nov 26 2012 (I finished my 1 year today)

However my PGWP is valid from Dec 19 2012 to Dec 19 2015...

Can I apply now or I have to wait till Dec 19 to apply because as per the PGWP, I still haven't completed my 1 year on my PGWP

Please advice as I am all set to submit my application

For safety you should just apply after Dec 19th.

If you have started your work prior the validity day of your PGWP it means that you worked illegally and you will be found inadmissible to Canada. Only the experience gained under VALID work permit will be counted towards the eligibility under CEC stream.

if he had off campus WP he is entitled to work before getting PGWP

IF. But in any case the work experience will not be counted if he didn't had his degree yet.

From CIC Guide 5609 :

Any periods of self-employment, unauthorized work, work in an ineligible occupation, and periods of employment during which you were engaged in full-time study (e.g. work experience gained on a co-op, off-campus or on-campus work permit) will not be included when calculating the period of qualifying work experience. You must have had temporary resident status during the period of work experience acquired in Canada.

If you are a student and graduated from a Canadian post-secondary institution, you can gain the work experience required for CEC through the Post-Graduate Work Permit.

I am in the same situation but the difference is that I already sent my application :(
I graduated in Aug 2012 and started working from Oct 15, 2012 to Nov 20,2012 on Off campus WP and since Nov 21, 2012 I am working on PGWP. The letter which I got from my employer is dated Nov 4, 2013 and I applied on Nov 11, 2013. If they are not including work under OCWP in 1 year Work experience then I'm short by some days.

What's important is your convocation date. Any experience prior to that date does not count. Any experience prior to PGWP doesn't count either. There have been lots of rejections on that before, you guys should read forum more carefully...

Just to clarify below are my details:

Applied for PGWP: Nov 8 2012
Off-Campus WP expired on: 30 Nov 2012
PGWP Received: 19 Dec 2013

From Dec 1 to Dec 18 - I was working and I was told that it is okey to work legally if you have already applied for PGWP before it is expired (which I did)...

I can wait till Dec 19 to apply. that's not a problem however please tell me that Dec 1 to Dec 18 will not be counted as illegal work..

can they reject my case on this basis?

its not considered illegal work because you were under implied status, but you can not include it towards your one year of work experience to qualify under CEC.

thank you canadavisa13

I was pretty sure thats the case but just wanted to confirm.. So I will have to apply for CEC after Dec 19th... :)

my PGWP says Dec 19 2012 to Dec 19 2015...

can I apply on Dec 19 2013 or Dec 20 2013? I don't want to delay this anymore ;D

you are welcome new_guy :)

do not apply exactly on DEC 19,give yourself a few more days just to be on the safe side,i would wait an extra week its not a big deal.
just make sure that your reference letter will be dated after DEC 19.

good luck :)

It's always good to have a few extra days as a buffer.
When was your convocation? The reason I am asking is that I remember reading on this form where someone got rejected because the only working hours that counts towards experience is the ones after the convocation.

My convocation was sometime in August 2012 so I think I am safe there..

canadavisa13: I want to apply ASAP because of the 200 CAP... I did not take any leave, not even a single day in last 1 year.. still wait for a week?
