Urgent - need advice!

Hello everyone!

This is my first post here, as I have been reading the threads and it seems like such a helpful community.
I am a Canadian citizen that was born here. My husband was selected for Express Entry through CEC and his biometrics were requested. Biometric collections are still closed, and the issue is my husband’s passport expires July 23.

His country has mandatory military service and they are refusing to renew his passport until he completes one year of service, or turns 30 which is when he will be exempt from service.

We were told by two lawyers to apply for Family Sponsorship PR, as Canada forgives staying in the country past the passport expiry in these cases. We are nervous to take this advice, as we do not want him banned from the country.

We have also considered applying to extend his work permit, so that would give him implied status and hopefully enough time to get biometrics complete once the country opens back up. However, we are unsure if implied status applies when the applicants passport expires, or if PR will even be issued with an expired passport.

Does anyone have any advice? This situation seems so confusing and hopeless, any guidance or ideas would be appreciated

Hi, my partner is in a similar situation where his passport is expired, he can't renew it, and he is required to submit biometrics soon for PR Express Entry CEC - Do you mind sharing what happened with your case? did your husband end up being able to provide biometrics with an expired passport? Did Service Canada accept alternative identification document?

Hi there,

My husband returned to his native country, and supplied his biometrics from a collection site there. I do not believe that you need a valid passport to submit biometrics, but it will be needed to process his PR application.

My husband received an email from CIC requesting an updated passport for his application, and we have replied and asked for an extension, or for them to process the application with the expired passport, and he will supply the new one when he is able to. I’m not sure if this will be successful, but crossing our fingers. As soon as he gets an update, I can let you know.

Ah okay I see.
For biometrics in Canada, they say that you need to bring with your your passport. I have been looking everywhere for people who had to provide it without a passport but couldn't find anything!

We have also received a letter for a new passport because the passport expired after he applied, we are planning to submit a letter of explanation.

If it makes you feel any better, IRCC are used to dealing with people with expired passports and can't renew them (specifically passports seized and expired by CBSA, like our case). IRCC does waive the passport requirement in specific cases for PR landing, you can read more here: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/bulletins-2013/553-october-17-2013.html
