Urgent !!!!! misrepresentation

I just joined to this group my name is Marco now i am living in Australia.
the last December i had applied for a Whv in Canada and to the question ( where are you currently living) i had put Australia and they denied my visa because i must apply from Italy.
i had tried to apply a second time for Whv Canada and this time at the question (where r you living) i had put Italy and they send me an e mail and ask me to prove where i lived in the last 10 year so i decided to withdraw the application and they accepted.
7 weeks ago my girlfriend applied for a student visa and i applied for open work permit as a common law partner but last week the Canadian government asked me the police check from every country in which i lived for more the 6 months.
obviously i did a misrepresentation but i had withdrawn the application before they would denied it. my question is why they ask me the police check for the last 10 years because of my misrepresentation or for other reasons?

Others can comment but a police check is pretty normal for any country where you spent 6 months or more in last 10 years nothing to do with any misrepresentation which if happened would be dealt with separately if at all for the reasons you mentioned.. not personally sure if for a spouse permit is 6 months in a row or accumulation of 6 months but expect the request will tell you.

Instructions how to get a check can be found on the CIC site, for Australia depending which state you have lived in from what I heard not straight forward compared to some countries. Especially if Queensland or Victoria where driving/ traffic history required in addition to police report even if never driven

thank for your replay... i had lived for 3 weeks in quuensland and from february 2018 until now in victoria... so i am not sure if i have to get the traffic history from both state s

i had tried to get the traffic history from the State of Victoria but they ask me for a Australian driver License and i don t have, I have my Italian driver license translated in English and i had tried to put it but as i expected hasn t worked

Hi Marco!

I do not think it could be considered as miss representation. Criminal check is quite normal practice. Criminal check can be asked for several reasons especially for those applicants who have the travel history of living outside of home country for more that 6 months. It is not complicated to get police criminal check you have to approach the respective authorities in those countries where you lived more than 6 months such as Ministry/Department of Internal Affairs, National/Federal Police Authorities, Ministry of Foreign Affairs, etc. I guess for Australia you need to approach Australian Federal Police you can follow the link below for further instruction or confirmation https://www.afp.gov.au/what-we-do/services/criminal-records/national-police-checks Remember depending on the country it could take up to 3 months to get criminal check report, so you need to apply asap. You currently don't have a misrepresentation finding if that was the case you would have received a fairness letter, however it seems it was found out but the officer was trying to build the case on you on a balance of probabilities, and he needed your input for that but you withdrew.

Now in your current visa application the fact that you are requested to provide address history and police certificates doesn't mean you will be approved it's just that they might want to collect as much information about you and establish your criminal history before finally sending you a fairness letter about your previous misrepresentation.

In any case your visa may be denied because you have no established residence and you don't have clear intent as to the purpose of travel to Canada other than working. Also you are already flagged in IRCC because the previous officer wrote a report about you in their systems. You should order GCMS notes and go from there.

Work visas for spouses/common law are not guaranteed for international students just so you are aware and have a plan b if needed.
