my name is Mann
i came here on study permit in Dec 2007 and i got post graduation work permit in Nov 2008 - Nov 2009
then due to family matters i have to go back so,i applied for study visa in Sep 2009 and got till July 2010.
i went to my country in Dec 2009 and came back in Feb 2010 then i send application for my extension in may but i got result
in Nov 2010 saying you have done unauthorized work so your application is rejected.

during this time i got married in may 2010 she was here on study visa till Dec 2011
then in Nov 2010 i applied on spousal visa but got rejected in may 2011 saying this type of visa cannot be issued inside within the country
as it is over 90 days.from July 2010 i am still living in Canada.
my wife got 3 years work permit and she is working as a Early Childhood assistant teacher.

what should i do? should i leave the country and apply from outside?
Are they going to issue me visa from outside of country?
i can't leave my wife alone.

Can you explain a little more about the refusal of your spousal sponsorship, I don't quite understand the phrase "this type of visa cannot be issued inside within the country as it is over 90 days." What is over 90 days?

i applied for open work permit on spouse basis.
i am out of status from July 2010 and i am in Canada with my wife
According to Canadian immigration law you have to apply within 90 of visa expiration.

You need to go home before CBSA comes calling and writes a report against you for overstaying your visa.

From home submit your application for landing under the family class spousal with your wife as sponsor.

It appears you were seeking earlier to apply for a visa extension under restoration and missed the cut-off. Usually at that time you would have received a letter from CIC telling you to leave along with their decision.

Presently you are aware that you are an overstay on coming up to 2 years. You are not entitled to a work permit from within Canada as CIC has indicated. If you have not yet had an answer to the in Canada spousal you could try and wait that out, but as noted above you run the risk of being ordered excluded by CBSA for being an overstay and possibly working without authorization. See the first line of this post for the best advice to you.

i tried once for visitor visa from my home country in july 2012 and got rejected saying ..if u want to apply in future do so if any condition change or u have new information..
my wife came to meet me in aug 2012 noww she is pregnant ..can i apply for visitor visa?..what are the chances of getting visa?

my wife applied for PR under CEC in march 2013 and we have received AOR on 29 april 2013 .
now our baby is due in june and i am still in india and she is alone in canada..

i am trying for visitor visa.. i don't know whether i will get the visa or no.

can someone please help or advice what can i do?

You can certainly apply for a visit visa. However none of us here can tell you if it will be approved or not.

what documents can i do to show my ties with india.

the reason visa officer give

that i am not satisfied that you will leave Canada at the end of visa

families ties in canada and in country of india ( is he dumb)

my financial assets (i showed $6500, my wife showed $18,500 and my father $38000)

Hi mannte,

You might better off posting this question under family class sponsorship.
There should be a way for you since you have a wife who has a legal status in Canada.
