Urgent! Help! Visitor Visa

Hi, I applied for a visitor visa for Canada in 2018 and it was refused on standard grounds like purpose of visit, travel history and financial status. However, that is not the issue of concern. The problem is related to the option on the form on the form which is related to the US visa refusal. My application was applied and filed by some agent and I know that I specifically told him to mention that my US refusal was refused. Now, I intent to apply again for tourist visa to Canada. However when I was checking the form that I had sent to him, the option to have you ever denied visa is ticked to NO.

This is scarring me. Is there a way to know for sure what was actually mentioned in the application. I have reached out to the agent who applied my application he has lost all the data.

What should I do? is there a way to inform the authority. I have heard there is a 5 years ban for misrepresentation.

Tick no plus a short but detailed explanation the reason.

You have to say YES or it is misrepresentation. Talk to your agent about updating file.

There's nothing you can do to fix an application from 2018.

When you apply for the TRV now, you will need to declare two past refusals - both the US refusal and the Canadian TRV refusal.

If you had been banned for misrepresentation in your 2018, your refusal email would state this. Do you have your refusal email? If you do not have the refusal email, then your only option would be to order your GCMS notes before you apply for the new TRV to see the details of that 2018 refusal. It will take at least 30 days for the GCMS notes to arrive (quite possibly longer).

Or you can just apply and see what happens. However you definitely need to make sure you declare both past refusals.

I just wanted to inform you about the new situation. So I recently applied for a TRV along with my mother.

I got a refusal, citing the purpose of the trip and insufficient funds.

As I said earlier in 2018, my application was submitted through someone, and the person failed to mention my US refusal. However, this time, I applied through a licenced RCIC professional and made a complete disclosure about the US refusal as well as my Canadian refusal of 2018. However, again, I faced a rejection despite showing 35–40k CAD in my bank account and around 95k CAD in savings. I am unable to understand the process and the reason for the refusal.

The consultant I hired is suggesting that, though there is no adverse mention in the 2018 GCMS notes, It might happen that the non-disclosure of US refusals in 2018 is still affecting my credibility, and that is the reason for the refusal now.


I am unable to understand what to do. He is suggesting the path of judicial review, which is very costly. I just wanted to visit my real brother, who moved to Canada in 2022.

Please guide.

The refusal letter of 2018 cited 3 grounds - Purpose of trip, insufficient funds and travel history. No ban and misrepresentation was cited. The GCMS notes of 2018 refusal did not mention that as well.

You need to tell us your full profile such as length of trip requested, country of origin, country of residency, how your brother immigrated to Canada, and what evidence of ties to your home country you and your mother have shown. Also, why the US visas were refused - it sounds like there were multiple refusals?

Country of origin: Delhi, India,
Country of residency: Delhi, India,
how your brother immigrated to Canada: PR with my sister in law in 2022, and
what evidence of ties to your home country you and your mother have shown: I am a lawyer, I showed letters from my clients, ITR, Bank statements, Partnership firm.
My mother: My father was not going with us.
Also, why the US visas were refused: I was a fresh graduate when I applied for US Visa in 2012. I applied twice in 2012 and the same was refused.
Right now, I am unmarried above 30 years of age but I have sufficient savings and regular income from my self-employed work wherein I am generating more than 1 lac INR every month.
