My parents have stayed almost 3 yrs outside Canada. By Feb 2017, they have to re-enter Canada and stay for next 2 yrs fully to complete the minimum requirement of staying 2 yrs within Canada to keep their PR status. I am faced with a difficult situation now. I am getting married after Feb most probably around May 2017. My parents NEED to be at my wedding ceremony. Which scenario will be the right one ?

1. Can my parents re-enter Canada now and seek extension for 6 months for my wedding? Will the CIC oblige to this request (request for attending child's marriage)?
2.Can my parents stay until my marriage till May 2017 and go soon after that. They would be overstaying outside Canada in this case. So when they land in Canada, will they be stopped from entering ? Will they be deported back ? OR will they allow to re-enter but with some conditions attached OR will they be allowed to re-enter but during renewal of their PR again, they would be barred. What can/will happen ?

Anyone pls help soon!!

1. No, they can't seek any sort of extension. IRCC really won't care what the reason is.

2. If they enter Canada without meeting the RO, then they face the risk of being reported, resulting in the loss of PR status unless they can prove strong H&C grounds for remaining out of Canada.


If your parents 3 years is up in February, then the very simple solution is for them to return to Canada BEFORE that so that they have enough of a buffer time to go to your wedding.

Can they request local Visa Office now itself before entering Canada. Will the local VO grant such a request, so that they can show this approval letter later when they land in Canada ?

Any other possible option that you can suggest please ?

RO = Residency Obligation.

H&C = Humanitarian and Compassionate.


As I have already said, no, they can't request permission from IRCC to violate the Residency Obligation. I have given you the only possible solution that does not risk their PR: they must return to Canada sooner.
