Hi,
Kindly help and advise
I have a PR card along with my wife and one child which is still valid and will expire in Dec 2015
we didn't met the residency requirements as we landed in Canada and didn't stay there. This was all personal reasons
However life has taken a turn and my wife is due to give birth to our second child, we wish to deliver in Canada and are ready to bear all the expenses by ourselves. At least one of our child will have the privilege to have Canadian citizenship though rest of us missed

1 - We are planning that my wife and daughter go first in Canada , I understand that it is very highly that they will be reported to CIC by an immigration officer however will they STOP them to enter Canada ? how likely it is

2- lets assume that they are lucky and were allowed to enter Canada, I am planning to follow them after a month, will the above reporting to CIC will have an impact for my entry in CANADA , will they stop me ?

3- lets assume that they allow me as well, will we face any legal issues in getting passport for our baby born in Canada?

4- Kindly help

Regards,
KJ

1 & 2) You and your family will be allowed entry into Canada because all of you are still PR. That is your right as a PR and you are still PR regardless of your RO unless CIC has explicitly revoked your PR. The only question is if CBSA will report you to CIC to investigate your RO and if CIC decides to revoke your PR. No one knows the chances of getting reported. It all depends on the officer you see at immigration. What helps is that your PR card has not expired yet. No guarantee but I think they are nicer if your PR card did not expire and they may let you in without issue. But no one can tell you what the chances are.

3) Assuming your PRs are not revoked and your wife does not have to leave Canada before the child is born, your child will be a Canadian citizen if he/she is born in Canada and should not have any legal issues getting a passport.

Thanks Keesio, appreciate your advise

Lets assume when my wife and daughter lands , they are reported to CIC, but were allowed entry in Canada, I have few question

1) Will I be allowed entry as I will join them after a month
2) How much time normally CIC takes to revoke PR
3) Lets assume CIC decides to revoke our PR , how much time they will be giving us in order for us to leave Canada
4) If the above takes few months, my wife deliver in Canada, will our revoke PR card status , have an impact on the newborn having CANADIAN citizenship/passport

Pls help

1) Yes. As PR, you will be allowed entry. Again the only question is if CBSA reports you
2) No one knows for sure because the time can vary. You can always appeal the decision and that will make things longer.
3) I'm not sure. I think I've seen some people say about a month. But I really don't know
4) If your child is born in Canada, then your child will be Canadian. The status of you and your wife does not matter. All that matters is the child being born in Canada.

Again, you only have an issue if CBSA reports you. Some CBSA officers are sympathetic (or indifferent) and many people have been let in without being reported. Just be polite and completely honest with them and hope for the best. The second a CBSA officer even suspects a little that you might be lying or hiding some truths, they will give you a a hard time for sure.
