I have granted permanent residency last year under dependent child. And now, I am sponsoring my wife under spousal family sponsorship, but i just receive an email from immigration stating that my residency will be excluded and her application will be denied, since they think that we live together in other country.
But we didn't.
We are living in the same area, but not in the same building. My wife is living with her family, including her mother, brother, sister, Her auntie that is married to a local emirati in Abu dhabi,in 5th street( building has no name, but the building is name by its landmark.
While I am renting a bed space near her area in the 8th street.
The buildings here in Abu dhabi doesn't have a proper name but have only a building number, that is why people named the buildings here, only by its landmark.

My wife's family doesn't allowed us to live together until we are married, and it is also not allowed here in UAE to live together unless you are married. Some still do it but if they get caught they will suffer the consenquenBut we do see each other on our day-offs and especial occasions and often visits her.
They are asking us to send some proofs that we are not living together, can you please help me on how to prove that we don't really live together since it is the truth.

Were you married at the time that you were sponsored? You keep calling her your wife.
Sorry, that time she is still my girlfriend, we got married last January and applied the application after that. But the immigration thinks that we lived together. and saying that it is falling under common law partner.

Are you currently living with her outside of Canada?
Sorry if it is not clear,
No she is living in uae, and i am now residing here in canada, but i have lived in uae also from 2014 until my PR has been granted. But we are not living together before we got married, we are just living in the same area. But the migration officer thinks that We live together, and it is not allowed since my application before is under dependent child. Then now thinking of cancelling my PR and denying her application.

Oh ok, just wanted to make sure that wasn't the issue. Maybe you could ask both sets of parents to write letters to vouch that you were living with them and not with each other?

She lives with her emirati auntie that time and i am renting a bed space. Do you think it is enough if we will send a testifying letter of my landlord before including his tenancy contract since he is also renting, as expats are not allowed to own a property here unless you are emirati and her auntie's testifying letter and her aunt's tenancy contract. And a map showing that it is same area but not same building? Thank you.

Her mother can send a letter as well since she lives with her mother, but my mother is the one to sponsor me and she is in already canada that time, and my father died since i was 4years old. So for me only landlord can testify that we didnt live together

I can't say if it's enough for sure, but I think it's a pretty good start. Do you have rent receipts from this landlord too? Maybe if you recieved mail there as well. Also a letter from your family or friends stating your address, since they would have known where you were renting?

I don't have since, i am only paying cash to him without any receipts. But he said he can make a letter that testifies that i have rented to him on that period.

You probably have lots of suggestion by now. I don't want to got through all the comments.

My two cents on your original post.

1) Since you applied after you get married then why IRCC care about if you lived together or not. Unless, you did not attached the marriage certificate and other marriage proof. FYI, one who is sponsoring the wife must include lots of proof of marriage to convince the visa officer that marriage is genuine. Only marriage certificate would not help you to get immigration done.

2) Despite above fact, if IRCC still questioning about you two living together before marriage and want to put under common law then I would say try to provide proof about the address and buildings. Even take pictures of two address. Map the houses on the Google map. Get affidavits or certificate from local official etc.

Good luck!

Since my permanent residency has been approved under dependent child of my mother, i shall not have common law partner, any dependents or spouse, but as per they email they are thinking that i may have a common law partner that is why they are asking any proof.
