I'd be so grateful if someone could advise on the following:
My husband and I are living and working in Ontario on a 2 year permit at the moment. We have applied for PR under the Ontario Immigrant Nominee Program (ONIP) (nominated by my current employer) and I have been nominated by Ontario and have a 'Confirmation of Nomination' certificate. I am just working on pulling together the PR paper application for Nova Scotia at the moment.
However, given that my employer has nominated me for the OINP process, the certificate has a 'restriction on employment' in it which ties it to that employer.
The ONIP confirmation letter said to apply for a 'temporary work permit' and it also contains an appendix A which is a 'letter of support' from Ontario to support the application for a temporary work permit while the PR application is processed.
HOWEVER, it now appears that to apply for an bridging open work permit using the Ontario Nominee certificate, there is a line on the CIC website that specifically says 'If you applied under the Provincial Nominee Program, you must not have employment restrictions as conditions of your nomination.'
This is why the work permit application has been refused, because we have that restriction. (we did not know about this before)
So, with 10 weeks left until our current work permits expire, what do we do? We need a work permit to be issued while our PR application is processed, but I don't know what we apply for from here?
